55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a modified instructional calendar for public high
88 schools providing an early college education program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.081(a), Education Code, is amended to
1111 read as follows:
1212 (a) Except as authorized under Subsection (b) of this
1313 section, Section 25.084, [or] Section 29.0821, or Section
1414 29.908(e), for each school year each school district must operate
1515 so that the district provides for at least 180 days of instruction
1616 for students.
1717 SECTION 2. Section 25.0811(a), Education Code, is amended
1818 to read as follows:
1919 (a) A school district may not begin instruction for students
2020 for a school year before the fourth Monday in August unless:
2121 (1) the district operates a year-round system under
2222 Section 25.084; or
2323 (2) the district is authorized to modify the
2424 instructional calendar as provided by Section 29.908(e).
2525 SECTION 3. Section 29.908, Education Code, is amended by
2626 adding Subsection (e) to read as follows:
2727 (e) A school district may allow a district high school that
2828 provides an early college education program under this section to
2929 modify the instructional calendar of the high school as necessary
3030 to conform with the calendar of a college, university, or technical
3131 school with which the high school has entered into an articulation
3232 agreement as provided by Subsections (b)(3) and (b-1). The
3333 commissioner shall adopt rules to administer this subsection.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2009.
