| 8 | 8 | | schools providing an early college education program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 25.081(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) Except as authorized under Subsection (b) of this |
|---|
| 13 | 13 | | section, Section 25.084, [or] Section 29.0821, or Section |
|---|
| 14 | 14 | | 29.908(e), for each school year each school district must operate |
|---|
| 15 | 15 | | so that the district provides for at least 180 days of instruction |
|---|
| 16 | 16 | | for students. |
|---|
| 17 | 17 | | SECTION 2. Section 25.0811(a), Education Code, is amended |
|---|
| 18 | 18 | | to read as follows: |
|---|
| 19 | 19 | | (a) A school district may not begin instruction for students |
|---|
| 20 | 20 | | for a school year before the fourth Monday in August unless: |
|---|
| 21 | 21 | | (1) the district operates a year-round system under |
|---|
| 22 | 22 | | Section 25.084; or |
|---|
| 23 | 23 | | (2) the district is authorized to modify the |
|---|
| 24 | 24 | | instructional calendar as provided by Section 29.908(e). |

| 25 | 25 | | SECTION 3. Section 29.908, Education Code, is amended by |
|---|
| 26 | 26 | | adding Subsection (e) to read as follows: |
|---|
| 27 | 27 | | (e) A school district may allow a district high school that |
|---|
| 28 | 28 | | provides an early college education program under this section to |
|---|
| 29 | 29 | | modify the instructional calendar of the high school as necessary |
|---|
| 30 | 30 | | to conform with the calendar of a college, university, or technical |
|---|
| 31 | 31 | | school with which the high school has entered into an articulation |
|---|
| 32 | 32 | | agreement as provided by Subsections (b)(3) and (b-1). The |
|---|
| 33 | 33 | | commissioner shall adopt rules to administer this subsection. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2009. |
