44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to enrollment requirements for the operation of Texas A&M
77 University--San Antonio as a general academic teaching institution
88 and the issuance of bonds for that institution.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (d), Section 87.841, Education Code,
1111 is amended to read as follows:
1212 (d) Notwithstanding any other provision of this subchapter,
1313 Texas A&M University--San Antonio may not operate as a general
1414 academic teaching institution until the Texas Higher Education
1515 Coordinating Board certifies that enrollment at the Texas A&M
1616 University--Kingsville System Center--San Antonio has reached an
1717 enrollment equivalent of[:
1818 [(1)] 1,000 full-time students for one semester [if
1919 the legislature authorizes revenue bonds to be issued to finance
2020 educational and related facilities for the institution, and the
2121 bonds are issued for that purpose; or
2222 [(2) 2,500 full-time students for one semester if the
2323 conditions specified by Subdivision (1) are not satisfied].
2424 SECTION 2. Subsection (e), Section 55.1751, Education Code,
2525 is amended to read as follows:
2626 (e) Notwithstanding Subsection (a), The Texas A&M
2727 University System may not issue bonds under this section for
2828 facilities at Texas A&M University--San Antonio until the Texas
2929 Higher Education Coordinating Board certifies that enrollment at
3030 Texas A&M University--San Antonio has reached an enrollment
3131 equivalent of 1,000 [1,500] full-time students for one
3232 semester. [If that enrollment is not reached by January 1, 2010,
3333 the system's authority to issue bonds for Texas A&M University--San
3434 Antonio under this section expires on that date.]
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each House, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2009.
