| 8 | 8 | | and the issuance of bonds for that institution. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (d), Section 87.841, Education Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | (d) Notwithstanding any other provision of this subchapter, |
|---|
| 13 | 13 | | Texas A&M University--San Antonio may not operate as a general |
|---|
| 14 | 14 | | academic teaching institution until the Texas Higher Education |
|---|
| 15 | 15 | | Coordinating Board certifies that enrollment at the Texas A&M |
|---|
| 16 | 16 | | University--Kingsville System Center--San Antonio has reached an |
|---|
| 17 | 17 | | enrollment equivalent of[: |
|---|
| 18 | 18 | | [(1)] 1,000 full-time students for one semester [if |
|---|
| 19 | 19 | | the legislature authorizes revenue bonds to be issued to finance |
|---|
| 20 | 20 | | educational and related facilities for the institution, and the |
|---|
| 21 | 21 | | bonds are issued for that purpose; or |
|---|
| 22 | 22 | | [(2) 2,500 full-time students for one semester if the |
|---|
| 23 | 23 | | conditions specified by Subdivision (1) are not satisfied]. |

| 24 | 24 | | SECTION 2. Subsection (e), Section 55.1751, Education Code, |
|---|
| 25 | 25 | | is amended to read as follows: |
|---|
| 26 | 26 | | (e) Notwithstanding Subsection (a), The Texas A&M |
|---|
| 27 | 27 | | University System may not issue bonds under this section for |
|---|
| 28 | 28 | | facilities at Texas A&M University--San Antonio until the Texas |
|---|
| 29 | 29 | | Higher Education Coordinating Board certifies that enrollment at |
|---|
| 30 | 30 | | Texas A&M University--San Antonio has reached an enrollment |
|---|
| 31 | 31 | | equivalent of 1,000 [1,500] full-time students for one |
|---|
| 32 | 32 | | semester. [If that enrollment is not reached by January 1, 2010, |
|---|
| 33 | 33 | | the system's authority to issue bonds for Texas A&M University--San |
|---|
| 34 | 34 | | Antonio under this section expires on that date.] |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each House, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2009. |
|---|
