| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Sections 34.0021(a) and (b), Education Code, are |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (a) A [Pursuant to the safety standards established by the |
|---|
| 12 | 12 | | Department of Public Safety under Section 34.002, each] school |
|---|
| 13 | 13 | | district may elect to [shall] conduct [a] training [session] for |
|---|
| 14 | 14 | | students and teachers concerning procedures for evacuating a school |
|---|
| 15 | 15 | | bus during an emergency. |
|---|
| 16 | 16 | | (b) A school district that elects to conduct the school bus |
|---|
| 17 | 17 | | emergency evacuation training shall conduct the [school bus |
|---|
| 18 | 18 | | emergency evacuation] training in compliance with the safety |
|---|
| 19 | 19 | | standards established by the Department of Public Safety under |
|---|
| 20 | 20 | | Section 34.002 [at least twice each school year, with one training |
|---|
| 21 | 21 | | session occurring in the fall and one training session occurring in |
|---|
| 22 | 22 | | the spring. A portion of the training session must occur on a |
|---|
| 23 | 23 | | school bus and the training session must last for at least one |
|---|
| 24 | 24 | | hour]. |

| 25 | 25 | | SECTION 2. Sections 34.0021(d) and (e), Education Code, are |
|---|
| 26 | 26 | | repealed. |
|---|
| 27 | 27 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
