55 CONCURRENT RESOLUTION
66 WHEREAS, Katherine Riley alleges that:
77 (1) on March 30, 2008, while Katherine Riley was
88 walking eastward toward the Capitol Visitors Center on the north
99 sidewalk of 11th Street between Congress Avenue and Brazos Street
1010 in Austin, Texas, she was struck by a branch that fell from a tree
1111 located on the Texas State Capitol grounds;
1212 (2) as a result of being struck by the branch, Ms.
1313 Riley has incurred significant medical expenses totaling more than
1414 $85,000 for treatment of her injury and rehabilitation; and
1515 (3) Ms. Riley has been unsuccessful in seeking
1616 compensation from the State of Texas for her injury and medical
1717 expenses; now, therefore, be it
1818 RESOLVED by the Legislature of the State of Texas, That
1919 Katherine Riley is granted permission to sue the State of Texas and
2020 State Preservation Board subject to Chapter 107, Civil Practice and
2121 Remedies Code; and, be it further
2222 RESOLVED, That the executive director of the State
2323 Preservation Board and the attorney general be served process as
2424 provided by Section 107.002(a)(3), Civil Practice and Remedies
2525 Code.
