7 | 7 | | representatives and the senate and is being prepared for |

9 | 9 | | WHEREAS, The bill contains technical errors that should be |
---|
10 | 10 | | corrected; now, therefore, be it |
---|
11 | 11 | | RESOLVED by the 81st Legislature of the State of Texas, |
---|
12 | 12 | | Regular Session, That the enrolling clerk of the house of |
---|
13 | 13 | | representatives be instructed to make the following correction: |

14 | 14 | | Add the following appropriately numbered SECTION as the |
---|
15 | 15 | | next-to-last SECTION of the bill and renumber the last SECTION of |
---|
16 | 16 | | the bill accordingly: |

18 | 18 | | FUNDING: ABOLITION UNDER SUNSET REVIEW PROCESS POSTPONED. (a) |
---|
19 | 19 | | Notwithstanding any other law, a state agency that by law is |
---|
20 | 20 | | scheduled for abolition on September 1, 2009, in connection with |
---|
21 | 21 | | the process by which state agencies are periodically reviewed in |
---|
22 | 22 | | accordance with Chapter 325, Government Code, is not abolished on |
---|
23 | 23 | | September 1, 2009, and is not subject to the procedure after |
---|
24 | 24 | | termination prescribed by Section 325.017, Government Code, if the |
---|
25 | 25 | | agency is eligible to administer federal stimulus funds received by |
---|
26 | 26 | | this state under the federal American Recovery and Reinvestment Act |
---|
27 | 27 | | of 2009 (Pub. L. No. 111-5) or to monitor a program funded in whole |
---|
28 | 28 | | or part by federal stimulus funds. To provide for the orderly |
---|
29 | 29 | | expenditure of federal stimulus funds, the agencies are continued |
---|
30 | 30 | | in existence until September 1, 2011, or a later date as |
---|
31 | 31 | | subsequently determined by the 81st or 82nd Legislature. For |
---|
32 | 32 | | purposes of this section, the agencies that are eligible to |
---|
33 | 33 | | administer federal stimulus funds received by this state under the |
---|
34 | 34 | | federal American Recovery and Reinvestment Act of 2009 or to |
---|
35 | 35 | | monitor a program funded in whole or in part by federal stimulus |
---|
36 | 36 | | funds and that are continued in existence under this section to |
---|
37 | 37 | | provide for the orderly expenditure of federal stimulus funds are: |
---|
38 | 38 | | (1) the Texas Department of Transportation; |
---|
39 | 39 | | (2) the Texas Department of Insurance; |
---|
40 | 40 | | (3) the Texas State Affordable Housing Corporation; |
---|
41 | 41 | | (4) the Texas Racing Commission; and |
---|
42 | 42 | | (5) the Office of Public Insurance Counsel. |
---|
43 | 43 | | (b) Section 201.204, Transportation Code, is amended to |
---|
44 | 44 | | read as follows: |
---|
45 | 45 | | Sec. 201.204. SUNSET PROVISION. The Texas Department of |
---|
46 | 46 | | Transportation is subject to Chapter 325, Government Code (Texas |
---|
47 | 47 | | Sunset Act). Unless continued in existence as provided by that |
---|
48 | 48 | | chapter, the department is abolished September 1, 2011 [2009]. |
---|
49 | 49 | | (c) Section 31.004(a), Insurance Code, is amended to read as |
---|
50 | 50 | | follows: |
---|
51 | 51 | | (a) The Texas Department of Insurance is subject to Chapter |
---|
52 | 52 | | 325, Government Code (Texas Sunset Act). Unless continued in |
---|
53 | 53 | | existence as provided by that chapter, the department is abolished |
---|
54 | 54 | | September 1, 2011 [2009]. |
---|
55 | 55 | | (d) Section 2306.5521, Government Code, is amended to read |
---|
56 | 56 | | as follows: |
---|
57 | 57 | | Sec. 2306.5521. SUNSET PROVISION. The Texas State |
---|
58 | 58 | | Affordable Housing Corporation is subject to Chapter 325 (Texas |
---|
59 | 59 | | Sunset Act). Unless continued in existence as provided by that |
---|
60 | 60 | | chapter, the corporation is abolished and this subchapter expires |
---|
61 | 61 | | September 1, 2011 [2009]. |

62 | 62 | | (e) Section 18.01(a), Texas Racing Act (Article 179e, |
---|
63 | 63 | | Vernon's Texas Civil Statutes), is amended to read as follows: |

64 | 64 | | (a) The Texas Racing Commission is subject to Chapter 325, |
---|
65 | 65 | | Government Code (Texas Sunset Act). Unless continued in existence |
---|
66 | 66 | | as provided by that chapter, and except as provided by Subsections |
---|
67 | 67 | | (b) and (c) of this section, the commission is abolished and this |
---|
68 | 68 | | Act expires September 1, 2011 [2009]. |
---|
69 | 69 | | (f) Section 501.003, Insurance Code, is amended to read as |
---|
70 | 70 | | follows: |
---|
71 | 71 | | Sec. 501.003. SUNSET PROVISION. The office is subject to |
---|
72 | 72 | | Chapter 325, Government Code (Texas Sunset Act). Unless continued |
---|
73 | 73 | | in existence as provided by that chapter, the office is abolished |
---|
74 | 74 | | September 1, 2011 [2009]. |
---|
75 | 75 | | (g) The governor with the prior approval of the Legislative |
---|
76 | 76 | | Budget Board may direct that an agency receiving funds appropriated |
---|
77 | 77 | | by Article XII, Senate Bill 1, Acts of the 81st Legislature, Regular |
---|
78 | 78 | | Session, 2009 (the American Recovery and Reinvestment Act article |
---|
79 | 79 | | of the General Appropriations Act), shall transfer those funds in |
---|
80 | 80 | | an amount prescribed by the governor and allowed under federal law |
---|
81 | 81 | | to an agency listed under Subsection (a) of this section to |
---|
82 | 82 | | implement an initiative related to public safety, public integrity, |
---|
83 | 83 | | consumer protection, or fiscal soundness that the agency may |
---|
84 | 84 | | implement and for which under federal law the federal stimulus |
---|
85 | 85 | | funds may be used. |
