55 CONCURRENT RESOLUTION
66 WHEREAS, House Bill No. 4583 has been adopted by the house of
77 representatives and the senate and is being prepared for
88 enrollment; and
99 WHEREAS, The bill contains technical errors that should be
1010 corrected; now, therefore, be it
1111 RESOLVED by the 81st Legislature of the State of Texas,
1212 Regular Session, That the enrolling clerk of the house of
1313 representatives be instructed to make the following correction:
1414 Add the following appropriately numbered SECTION as the
1515 next-to-last SECTION of the bill and renumber the last SECTION of
1616 the bill accordingly:
1717 SECTION ____. STATE AGENCIES ELIGIBLE FOR FEDERAL STIMULUS
1818 FUNDING: ABOLITION UNDER SUNSET REVIEW PROCESS POSTPONED. (a)
1919 Notwithstanding any other law, a state agency that by law is
2020 scheduled for abolition on September 1, 2009, in connection with
2121 the process by which state agencies are periodically reviewed in
2222 accordance with Chapter 325, Government Code, is not abolished on
2323 September 1, 2009, and is not subject to the procedure after
2424 termination prescribed by Section 325.017, Government Code, if the
2525 agency is eligible to administer federal stimulus funds received by
2626 this state under the federal American Recovery and Reinvestment Act
2727 of 2009 (Pub. L. No. 111-5) or to monitor a program funded in whole
2828 or part by federal stimulus funds. To provide for the orderly
2929 expenditure of federal stimulus funds, the agencies are continued
3030 in existence until September 1, 2011, or a later date as
3131 subsequently determined by the 81st or 82nd Legislature. For
3232 purposes of this section, the agencies that are eligible to
3333 administer federal stimulus funds received by this state under the
3434 federal American Recovery and Reinvestment Act of 2009 or to
3535 monitor a program funded in whole or in part by federal stimulus
3636 funds and that are continued in existence under this section to
3737 provide for the orderly expenditure of federal stimulus funds are:
3838 (1) the Texas Department of Transportation;
3939 (2) the Texas Department of Insurance;
4040 (3) the Texas State Affordable Housing Corporation;
4141 (4) the Texas Racing Commission; and
4242 (5) the Office of Public Insurance Counsel.
4343 (b) Section 201.204, Transportation Code, is amended to
4444 read as follows:
4545 Sec. 201.204. SUNSET PROVISION. The Texas Department of
4646 Transportation is subject to Chapter 325, Government Code (Texas
4747 Sunset Act). Unless continued in existence as provided by that
4848 chapter, the department is abolished September 1, 2011 [2009].
4949 (c) Section 31.004(a), Insurance Code, is amended to read as
5050 follows:
5151 (a) The Texas Department of Insurance is subject to Chapter
5252 325, Government Code (Texas Sunset Act). Unless continued in
5353 existence as provided by that chapter, the department is abolished
5454 September 1, 2011 [2009].
5555 (d) Section 2306.5521, Government Code, is amended to read
5656 as follows:
5757 Sec. 2306.5521. SUNSET PROVISION. The Texas State
5858 Affordable Housing Corporation is subject to Chapter 325 (Texas
5959 Sunset Act). Unless continued in existence as provided by that
6060 chapter, the corporation is abolished and this subchapter expires
6161 September 1, 2011 [2009].
6262 (e) Section 18.01(a), Texas Racing Act (Article 179e,
6363 Vernon's Texas Civil Statutes), is amended to read as follows:
6464 (a) The Texas Racing Commission is subject to Chapter 325,
6565 Government Code (Texas Sunset Act). Unless continued in existence
6666 as provided by that chapter, and except as provided by Subsections
6767 (b) and (c) of this section, the commission is abolished and this
6868 Act expires September 1, 2011 [2009].
6969 (f) Section 501.003, Insurance Code, is amended to read as
7070 follows:
7171 Sec. 501.003. SUNSET PROVISION. The office is subject to
7272 Chapter 325, Government Code (Texas Sunset Act). Unless continued
7373 in existence as provided by that chapter, the office is abolished
7474 September 1, 2011 [2009].
7575 (g) The governor with the prior approval of the Legislative
7676 Budget Board may direct that an agency receiving funds appropriated
7777 by Article XII, Senate Bill 1, Acts of the 81st Legislature, Regular
7878 Session, 2009 (the American Recovery and Reinvestment Act article
7979 of the General Appropriations Act), shall transfer those funds in
8080 an amount prescribed by the governor and allowed under federal law
8181 to an agency listed under Subsection (a) of this section to
8282 implement an initiative related to public safety, public integrity,
8383 consumer protection, or fiscal soundness that the agency may
8484 implement and for which under federal law the federal stimulus
8585 funds may be used.
