7 | 7 | | this state and requiring the governor to call the legislature into |
---|
8 | 8 | | special session to consider gaming legislation. |

9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 47, Article III, Texas Constitution, is |
---|
11 | 11 | | amended by amending Subsection (a) and adding Subsections (f) and |
---|
12 | 12 | | (f-1) to read as follows: |
---|
13 | 13 | | (a) The Legislature shall pass laws prohibiting lotteries |
---|
14 | 14 | | and gift enterprises in this State other than those authorized by |
---|
15 | 15 | | Subsections (b), (d), [and] (e), and (f) of this section. |
---|
16 | 16 | | (f) The Legislature by general law shall establish a full |
---|
17 | 17 | | time state gaming commission and to authorize and provide for |
---|
18 | 18 | | regulating the conduct of one or more types of gaming, including |
---|
19 | 19 | | casino gaming, in this State to be located: |
---|
20 | 20 | | (1) on barrier islands adjacent to counties located |
---|
21 | 21 | | along the coast of the Gulf of Mexico; |
---|
22 | 22 | | (2) on lands held in trust by the United States in El |
---|
23 | 23 | | Paso County, Texas for the benefit of the Ysleta del Sur Pueblo, a |
---|
24 | 24 | | federally recognized Indian tribe, and lands held in trust by the |
---|
25 | 25 | | United States in Polk County, Texas for the benefit of the |
---|
26 | 26 | | Alabama-Coushatta Tribe, a federally recognized Indian tribe that |
---|
27 | 27 | | another federally recognized Indian tribe that owns or controls |
---|
28 | 28 | | federally recognized tribal land in this State is authorized by |
---|
29 | 29 | | state or federal law to conduct on that tribal land; |
---|
30 | 30 | | (3) a location with an existing pari-mutuel license; |
---|
31 | 31 | | (4) a municipality with a population of 675,000 or |
---|
32 | 32 | | greater. |
---|
33 | 33 | | (f-1) Not later than June 1, 2010, the governor shall call |
---|
34 | 34 | | the Legislature into special session for a period not to exceed 30 |
---|
35 | 35 | | days for the sole purpose of considering and enacting laws to |
---|
36 | 36 | | implement Subsection (f) of this section. This subsection expires |
---|
37 | 37 | | January 1, 2011. |
---|
38 | 38 | | SECTION 2. This proposed constitutional amendment shall be |
---|
39 | 39 | | submitted to the voters at an election to be held November 3, 2009. |
---|
40 | 40 | | The ballot shall be printed to provide for voting for or against the |
---|
41 | 41 | | proposition: "The constitutional amendment authorizing the |
---|
42 | 42 | | legislature to establish a full time state gaming commission and to |
---|
43 | 43 | | authorize and provide for regulating the conduct of gaming in this |
---|
44 | 44 | | state to be located on barrier islands of counties adjacent to the |
---|
45 | 45 | | Gulf of Mexico, lands held by federally recognized Indian tribes, |
---|
46 | 46 | | locations that have an existing gaming license, and municipalities |
---|
47 | 47 | | with populations of 675,000 or greater and requiring the governor |
---|
48 | 48 | | to call the legislature into special session to consider gaming |
---|
49 | 49 | | legislation." |
