44 A JOINT RESOLUTION
55 proposing a constitutional amendment authorizing the legislature
66 to authorize and provide for regulating the conduct of gaming in
77 this state and requiring the governor to call the legislature into
88 special session to consider gaming legislation.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 47, Article III, Texas Constitution, is
1111 amended by amending Subsection (a) and adding Subsections (f) and
1212 (f-1) to read as follows:
1313 (a) The Legislature shall pass laws prohibiting lotteries
1414 and gift enterprises in this State other than those authorized by
1515 Subsections (b), (d), [and] (e), and (f) of this section.
1616 (f) The Legislature by general law shall establish a full
1717 time state gaming commission and to authorize and provide for
1818 regulating the conduct of one or more types of gaming, including
1919 casino gaming, in this State to be located:
2020 (1) on barrier islands adjacent to counties located
2121 along the coast of the Gulf of Mexico;
2222 (2) on lands held in trust by the United States in El
2323 Paso County, Texas for the benefit of the Ysleta del Sur Pueblo, a
2424 federally recognized Indian tribe, and lands held in trust by the
2525 United States in Polk County, Texas for the benefit of the
2626 Alabama-Coushatta Tribe, a federally recognized Indian tribe that
2727 another federally recognized Indian tribe that owns or controls
2828 federally recognized tribal land in this State is authorized by
2929 state or federal law to conduct on that tribal land;
3030 (3) a location with an existing pari-mutuel license;
3131 (4) a municipality with a population of 675,000 or
3232 greater.
3333 (f-1) Not later than June 1, 2010, the governor shall call
3434 the Legislature into special session for a period not to exceed 30
3535 days for the sole purpose of considering and enacting laws to
3636 implement Subsection (f) of this section. This subsection expires
3737 January 1, 2011.
3838 SECTION 2. This proposed constitutional amendment shall be
3939 submitted to the voters at an election to be held November 3, 2009.
4040 The ballot shall be printed to provide for voting for or against the
4141 proposition: "The constitutional amendment authorizing the
4242 legislature to establish a full time state gaming commission and to
4343 authorize and provide for regulating the conduct of gaming in this
4444 state to be located on barrier islands of counties adjacent to the
4545 Gulf of Mexico, lands held by federally recognized Indian tribes,
4646 locations that have an existing gaming license, and municipalities
4747 with populations of 675,000 or greater and requiring the governor
4848 to call the legislature into special session to consider gaming
4949 legislation."
