9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 47, Article III, Texas Constitution, is | |
11 | 11 | amended by amending Subsection (a) and adding Subsection (f) to | |
12 | 12 | read as follows: | |
13 | 13 | (a) The Legislature shall pass laws prohibiting lotteries | |
14 | 14 | and gift enterprises in this State other than those authorized by | |
15 | 15 | Subsections (b), (d), [and] (e), and (f) of this section. | |
16 | 16 | (f) The Ysleta del Sur Pueblo Indian tribe may conduct | |
17 | 17 | gaming activity described under or by Indian Gaming Regulatory Act | |
18 | 18 | (Pub. L. No. 100-497) that would otherwise be subject to the | |
19 | 19 | prohibition prescribed by (a) of this section on land that was | |
20 | 20 | recognized as tribal land of that tribe by the United States on | |
21 | 21 | January 1, 1998. | |
22 | 22 | SECTION 2. This proposed constitutional amendment shall be | |
23 | 23 | submitted to the voters at an election to be held November 3, 2009. | |
24 | 24 | The ballot shall be printed to permit voting for or against the | |
25 | 25 | proposition: "The constitutional amendment authorizing the Ysleta | |
26 | 26 | del Sur Pueblo Indian tribe to conduct gaming activity on certain | |
27 | 27 | tribal lands." |
