44 A JOINT RESOLUTION
55 proposing a constitutional amendment authorizing a federally
66 recognized Indian tribe in a county along the Texas-Mexico
77 international border to conduct certain gaming activity on certain
88 tribal lands.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 47, Article III, Texas Constitution, is
1111 amended by amending Subsection (a) and adding Subsection (f) to
1212 read as follows:
1313 (a) The Legislature shall pass laws prohibiting lotteries
1414 and gift enterprises in this State other than those authorized by
1515 Subsections (b), (d), [and] (e), and (f) of this section.
1616 (f) The Ysleta del Sur Pueblo Indian tribe may conduct
1717 gaming activity described under or by Indian Gaming Regulatory Act
1818 (Pub. L. No. 100-497) that would otherwise be subject to the
1919 prohibition prescribed by (a) of this section on land that was
2020 recognized as tribal land of that tribe by the United States on
2121 January 1, 1998.
2222 SECTION 2. This proposed constitutional amendment shall be
2323 submitted to the voters at an election to be held November 3, 2009.
2424 The ballot shall be printed to permit voting for or against the
2525 proposition: "The constitutional amendment authorizing the Ysleta
2626 del Sur Pueblo Indian tribe to conduct gaming activity on certain
2727 tribal lands."
