| 9 | 9 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 49-g, Article III, Texas Constitution, |
|---|
| 11 | 11 | | is amended by adding Subsection (p) to read as follows: |
|---|
| 12 | 12 | | (p) Without the necessity of an appropriation, the governor |
|---|
| 13 | 13 | | may spend money from the economic stabilization fund as provided by |
|---|
| 14 | 14 | | this subsection when the governor determines it is necessary to pay |
|---|
| 15 | 15 | | the costs of responding to a natural disaster. The governor may not |
|---|
| 16 | 16 | | exercise the authority provided by this subsection more than once |
|---|
| 17 | 17 | | during a state fiscal biennium. In a state fiscal biennium, the |
|---|
| 18 | 18 | | governor may spend under the authority of this subsection not more |
|---|
| 19 | 19 | | than $100 million for purposes of temporary and emergency housing, |
|---|
| 20 | 20 | | with the money spent under an effort administered jointly by the |
|---|
| 21 | 21 | | governor, the Texas Department of Housing and Community Affairs or |
|---|
| 22 | 22 | | its successor in function, and the governor's division of emergency |
|---|
| 23 | 23 | | management or its successor in function. In a state fiscal |
|---|
| 24 | 24 | | biennium, the governor may spend under this subsection not more |
|---|
| 25 | 25 | | than an additional $150 million for the purposes for which a |
|---|
| 26 | 26 | | disaster contingency fund created by statute may be spent, with the |
|---|
| 27 | 27 | | money spent under an effort administered jointly by the governor |
|---|
| 28 | 28 | | and the governor's division of emergency management or its |
|---|
| 29 | 29 | | successor in function. |

| 30 | 30 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 31 | 31 | | submitted to the voters at an election to be held November 3, 2009. |
|---|
| 32 | 32 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 33 | 33 | | proposition: "The constitutional amendment relating to the use of |
|---|
| 34 | 34 | | money from the economic stabilization fund for response to a |
|---|
| 35 | 35 | | natural disaster." |
