99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 49-g, Article III, Texas Constitution,
1111 is amended by adding Subsection (p) to read as follows:
1212 (p) Without the necessity of an appropriation, the governor
1313 may spend money from the economic stabilization fund as provided by
1414 this subsection when the governor determines it is necessary to pay
1515 the costs of responding to a natural disaster. The governor may not
1616 exercise the authority provided by this subsection more than once
1717 during a state fiscal biennium. In a state fiscal biennium, the
1818 governor may spend under the authority of this subsection not more
1919 than $100 million for purposes of temporary and emergency housing,
2020 with the money spent under an effort administered jointly by the
2121 governor, the Texas Department of Housing and Community Affairs or
2222 its successor in function, and the governor's division of emergency
2323 management or its successor in function. In a state fiscal
2424 biennium, the governor may spend under this subsection not more
2525 than an additional $150 million for the purposes for which a
2626 disaster contingency fund created by statute may be spent, with the
2727 money spent under an effort administered jointly by the governor
2828 and the governor's division of emergency management or its
2929 successor in function.
3030 SECTION 2. This proposed constitutional amendment shall be
3131 submitted to the voters at an election to be held November 3, 2009.
3232 The ballot shall be printed to provide for voting for or against the
3333 proposition: "The constitutional amendment relating to the use of
3434 money from the economic stabilization fund for response to a
3535 natural disaster."
