8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 10, Article III, Texas Constitution, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Sec. 10. Two-thirds of the members of each House of the | |
12 | 12 | Legislature, excluding members whom the presiding officer | |
13 | 13 | determines are absent from the state, shall constitute a quorum to | |
14 | 14 | do business, but a smaller number may adjourn from day to day, and | |
15 | 15 | compel the attendance of absent members, in such manner and under | |
16 | 16 | such penalties as each House may provide. | |
17 | 17 | SECTION 2. This proposed constitutional amendment shall be | |
18 | 18 | submitted to the voters at an election to be held November 3, 2009. | |
19 | 19 | The ballot shall be printed to permit voting for or against the | |
20 | 20 | proposition: "The constitutional amendment to exclude a senator or | |
21 | 21 | representative who is absent from this state from the determination | |
22 | 22 | of a quorum needed for a house of the legislature to do business." |
