55 A JOINT RESOLUTION
66 proposing a constitutional amendment relating to the determination
77 of a quorum of the senate or house of representatives.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 10, Article III, Texas Constitution, is
1010 amended to read as follows:
1111 Sec. 10. Two-thirds of the members of each House of the
1212 Legislature, excluding members whom the presiding officer
1313 determines are absent from the state, shall constitute a quorum to
1414 do business, but a smaller number may adjourn from day to day, and
1515 compel the attendance of absent members, in such manner and under
1616 such penalties as each House may provide.
1717 SECTION 2. This proposed constitutional amendment shall be
1818 submitted to the voters at an election to be held November 3, 2009.
1919 The ballot shall be printed to permit voting for or against the
2020 proposition: "The constitutional amendment to exclude a senator or
2121 representative who is absent from this state from the determination
2222 of a quorum needed for a house of the legislature to do business."
