55 A JOINT RESOLUTION
66 proposing a constitutional amendment to entitle The University of
77 Texas at Brownsville to participate in the income and other
88 benefits of the permanent university fund.
99 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 18, Article VII, Texas Constitution, is
1111 amended by amending Subsection (b) and adding Subsection (b-1) to
1212 read as follows:
1313 (b) The Board of Regents of The University of Texas System
1414 may issue bonds and notes not to exceed a total amount of 20 percent
1515 of the cost value of investments and other assets of the permanent
1616 university fund (exclusive of real estate) at the time of issuance
1717 thereof, and may pledge all or any part of its two-thirds interest
1818 in the available university fund to secure the payment of the
1919 principal and interest of those bonds and notes, for the purpose of
2020 acquiring land either with or without permanent improvements,
2121 constructing and equipping buildings or other permanent
2222 improvements, major repair and rehabilitation of buildings and
2323 other permanent improvements, acquiring capital equipment and
2424 library books and library materials, and refunding bonds or notes
2525 issued under this section or prior law, at or for The University of
2626 Texas System administration and the following component
2727 institutions of the system:
2828 (1) The University of Texas at Arlington;
2929 (2) The University of Texas at Austin;
3030 (3) The University of Texas at Brownsville;
3131 (4) The University of Texas at Dallas;
3232 (5) [(4)] The University of Texas at El Paso;
3333 (6) [(5)] The University of Texas of the Permian
3434 Basin;
3535 (7) [(6)] The University of Texas at San Antonio;
3636 (8) [(7)] The University of Texas at Tyler;
3737 (9) [(8)] The University of Texas Southwestern
3838 Medical [Health Science] Center at Dallas;
3939 (10) [(9)] The University of Texas Medical Branch at
4040 Galveston;
4141 (11) [(10)] The University of Texas Health Science

5151 (b-1) In applying a portion of its two-thirds interest in
5252 the available university fund to the payment of the principal of and
5353 interest on bonds and notes issued under Subsection (b) of this
5454 section for the benefit of The University of Texas at Brownsville,
5555 the Board of Regents of The University of Texas System shall include
5656 sufficient funds to pay the principal of and interest on all bonds
5757 and notes, including refunding bonds and notes, previously issued
5858 for the benefit of that university under Section 17(b) of this
5959 article.
6060 SECTION 2. Section 17(b), Article VII, Texas Constitution,
6161 is amended to read as follows:
6262 (b) The funds appropriated under Subsection (a) of this
6363 section shall be for the use of the following eligible agencies and
6464 institutions of higher education (even though their names may be
6565 changed):
6666 (1) East Texas State University including East Texas
6767 State University at Texarkana;
6868 (2) Lamar University including Lamar University at
6969 Orange and Lamar University at Port Arthur;
7070 (3) Midwestern State University;
7171 (4) University of North Texas;
7272 (5) The University of Texas--Pan American [including
7373 The University of Texas at Brownsville];
7474 (6) Stephen F. Austin State University;
7575 (7) Texas College of Osteopathic Medicine;
7676 (8) Texas State University System Administration and
7777 the following component institutions:
7878 (9) Sam Houston State University;
7979 (10) Southwest Texas State University;
8080 (11) Sul Ross State University including Uvalde Study
8181 Center;
8282 (12) Texas Southern University;
8383 (13) Texas Tech University;
8484 (14) Texas Tech University Health Sciences Center;
8585 (15) Angelo State University;
8686 (16) Texas Woman's University;
8787 (17) University of Houston System Administration and
8888 the following component institutions:
8989 (18) University of Houston;
9090 (19) University of Houston--Victoria;
9191 (20) University of Houston--Clear Lake;
9292 (21) University of Houston--Downtown;
9393 (22) Texas A&M University--Corpus Christi;
9494 (23) Texas A&M International University;
9595 (24) Texas A&M University--Kingsville;
9696 (25) West Texas A&M University; and
9797 (26) Texas State Technical College System and its
9898 campuses, but not its extension centers or programs.
9999 SECTION 3. Article VII, Texas Constitution, is amended by
100100 adding Section 17A to read as follows:
101101 Sec. 17A. (a) The transfer of The University of Texas at
102102 Brownsville from Section 17 of this article to Section 18 of this
103103 article by the constitutional amendment proposed by the 81st
104104 Legislature, Regular Session, 2009, applies beginning with the
105105 state fiscal year that begins September 1, 2010.
106106 (b) Beginning with the state fiscal year that begins
107107 September 1, 2010, the funds allocated as provided by Section 17(d)
108108 of this article to The University of Texas at Brownsville shall be
109109 allocated to the other agencies and institutions eligible to
110110 receive funds under Section 17 of this article in proportion to the
111111 other funds allocated to those agencies and institutions as
112112 provided by Section 17(d) of this article, until the legislature or
113113 designated agency eliminates The University of Texas at Brownsville
114114 from the formula and allocations made under Section 17(d) of this
115115 article.
116116 (c) This section expires September 1, 2017.
117117 SECTION 4. This proposed constitutional amendment shall be
118118 submitted to the voters at an election to be held November 3, 2009.
119119 The ballot shall be printed to permit voting for or against the
120120 following proposition: "The constitutional amendment to entitle
121121 The University of Texas at Brownsville to participate in the income
122122 and other benefits of the permanent university fund."
