55 A JOINT RESOLUTION
66 proposing a constitutional amendment relating to the right to hunt
77 and fish.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article I, Texas Constitution, is amended by
1010 adding Section 33 to read as follows:
1111 Sec. 33. (a) Every person has the right to hunt and fish in
1212 this state in accordance with the laws of this state. Hunting and
1313 fishing are the preferred methods of managing wildlife species that
1414 are not classified as threatened species by the state agency
1515 responsible for maintaining the list of endangered or threatened
1616 species.
1717 (b) The legislature may enact a general law to define the
1818 term "threatened" with respect to indigenous species of fish or
1919 wildlife.
2020 SECTION 2. This proposed constitutional amendment shall be
2121 submitted to the voters at an election to be held November 3, 2009.
2222 The ballot shall be printed to permit voting for or against the
2323 proposition: "The constitutional amendment recognizing the right
2424 of a person to hunt and fish in this state, recognizing hunting and
2525 fishing as the preferred methods of managing wildlife species that
2626 are not classified as threatened species, and authorizing the
2727 legislature to enact a general law defining "threatened.""
