8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Article I, Texas Constitution, is amended by | |
10 | 10 | adding Section 33 to read as follows: | |
11 | 11 | Sec. 33. (a) Every person has the right to hunt and fish in | |
12 | 12 | this state in accordance with the laws of this state. Hunting and | |
13 | 13 | fishing are the preferred methods of managing wildlife species that | |
14 | 14 | are not classified as threatened species by the state agency | |
15 | 15 | responsible for maintaining the list of endangered or threatened | |
16 | 16 | species. | |
17 | 17 | (b) The legislature may enact a general law to define the | |
18 | 18 | term "threatened" with respect to indigenous species of fish or | |
19 | 19 | wildlife. | |
20 | 20 | SECTION 2. This proposed constitutional amendment shall be | |
21 | 21 | submitted to the voters at an election to be held November 3, 2009. | |
22 | 22 | The ballot shall be printed to permit voting for or against the | |
23 | 23 | proposition: "The constitutional amendment recognizing the right | |
24 | 24 | of a person to hunt and fish in this state, recognizing hunting and | |
25 | 25 | fishing as the preferred methods of managing wildlife species that | |
26 | 26 | are not classified as threatened species, and authorizing the | |
27 | 27 | legislature to enact a general law defining "threatened."" |
