9 | 9 | SECTION 1. Section 11, Article IV, Texas Constitution, is | |
10 | 10 | amended by adding Subsection (c) to read as follows: | |
11 | 11 | (c) The Governor may issue an order prohibiting the Texas | |
12 | 12 | Department of Criminal Justice from performing executions on and | |
13 | 13 | after the effective date of the order and until the order is | |
14 | 14 | revoked, either by the Governor issuing the order or by a successor | |
15 | 15 | to the Governor issuing the order. | |
16 | 16 | SECTION 2. This proposed constitutional amendment shall be | |
17 | 17 | submitted to the voters at an election to be held November 3, 2009. | |
18 | 18 | The ballot shall be printed to permit voting for or against the | |
19 | 19 | proposition: "The constitutional amendment authorizing a | |
20 | 20 | moratorium on the execution of persons convicted of capital | |
21 | 21 | offenses." |
