55 A JOINT RESOLUTION
66 proposing a constitutional amendment to prohibit the state or a
77 political subdivision of the state from taking private property for
88 the primary purpose of economic development or to benefit a

1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article I, Texas Constitution, is amended by
1212 adding Section 17A to read as follows:
1313 Sec. 17A. The state or a political subdivision of the state
1414 may not take private property through the use of the power of
1515 eminent domain if the primary purpose of the taking is for economic
1616 development or to benefit a particular private party.
1717 SECTION 2. This proposed constitutional amendment shall be
1818 submitted to the voters at an election to be held November 3, 2009.
1919 The ballot shall be printed to permit voting for or against the
2020 proposition: "The constitutional amendment to prohibit the state
2121 or a political subdivision of the state from taking private
2222 property for the primary purpose of economic development or to
2323 benefit a particular private party."
