11 | 11 | SECTION 1. Article I, Texas Constitution, is amended by | |
12 | 12 | adding Section 17A to read as follows: | |
13 | 13 | Sec. 17A. The state or a political subdivision of the state | |
14 | 14 | may not take private property through the use of the power of | |
15 | 15 | eminent domain if the primary purpose of the taking is for economic | |
16 | 16 | development or to benefit a particular private party. | |
17 | 17 | SECTION 2. This proposed constitutional amendment shall be | |
18 | 18 | submitted to the voters at an election to be held November 3, 2009. | |
19 | 19 | The ballot shall be printed to permit voting for or against the | |
20 | 20 | proposition: "The constitutional amendment to prohibit the state | |
21 | 21 | or a political subdivision of the state from taking private | |
22 | 22 | property for the primary purpose of economic development or to | |
23 | 23 | benefit a particular private party." |
