| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 4, Article IX, Texas Constitution, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | Sec. 4. (a) The Legislature may by law authorize the |
|---|
| 14 | 14 | | creation of county-wide Hospital Districts in counties having a |
|---|
| 15 | 15 | | population in excess of 190,000 and in Galveston County, with power |
|---|
| 16 | 16 | | to issue bonds for the purchase, acquisition, construction, |
|---|
| 17 | 17 | | maintenance and operation of any county owned hospital, or where |
|---|
| 18 | 18 | | the hospital system is jointly operated by a county and city within |
|---|
| 19 | 19 | | the county, and to provide for the transfer to the county-wide |
|---|
| 20 | 20 | | Hospital District of the title to any land, buildings or equipment, |
|---|
| 21 | 21 | | jointly or separately owned, and for the assumption by the district |
|---|
| 22 | 22 | | of any outstanding bonded indebtedness theretofore issued by any |
|---|
| 23 | 23 | | county or city for the establishment of hospitals or hospital |
|---|
| 24 | 24 | | facilities; to levy a tax not to exceed seventy-five ($.75) cents on |
|---|
| 25 | 25 | | the One Hundred ($100.00) Dollars valuation of all taxable property |
|---|
| 26 | 26 | | within such district, provided, however, that such district shall |
|---|
| 27 | 27 | | be approved at an election held for that purpose, and that only |
|---|
| 28 | 28 | | qualified voters in such county shall vote therein; provided |
|---|
| 29 | 29 | | further, that such Hospital District shall assume full |
|---|
| 30 | 30 | | responsibility for providing medical and hospital care to needy |
|---|
| 31 | 31 | | inhabitants of the county, and thereafter such county and cities |
|---|
| 32 | 32 | | therein shall not levy any other tax for hospital purposes; and |
|---|
| 33 | 33 | | provided further that should such Hospital District construct, |
|---|
| 34 | 34 | | maintain and support a hospital or hospital system, that the same |
|---|
| 35 | 35 | | shall never become a charge against the State of Texas, nor shall |
|---|
| 36 | 36 | | any direct appropriation ever be made by the Legislature for the |
|---|
| 37 | 37 | | construction, maintenance or improvement of the said hospital or |
|---|
| 38 | 38 | | hospitals. |

| 39 | 39 | | (b) Notwithstanding Subsection (a) of this section, the |
|---|
| 40 | 40 | | boundaries of the Dallas County Hospital District may be expanded |
|---|
| 41 | 41 | | to include territory outside Dallas County if a majority of the |
|---|
| 42 | 42 | | qualified voters of the district and a majority of the qualified |
|---|
| 43 | 43 | | voters of the territory to be included in the district approve the |
|---|
| 44 | 44 | | expansion at separate elections called and held for that purpose. |
|---|
| 45 | 45 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 46 | 46 | | submitted to the voters at an election to be held November 3, 2009. |
|---|
| 47 | 47 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 48 | 48 | | proposition: "The constitutional amendment to allow the Dallas |
|---|
| 49 | 49 | | County Hospital District to expand its boundaries." |
