9 | 9 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Article IV, Texas Constitution, is amended by | |
11 | 11 | adding Section 22a to read as follows: | |
12 | 12 | Sec. 22a. To the extent provided by general law, the | |
13 | 13 | attorney general may represent the state in the district and | |
14 | 14 | inferior courts in the prosecution of criminal and civil offenses | |
15 | 15 | that: | |
16 | 16 | (1) arise under the campaign finance laws of this | |
17 | 17 | state; and | |
18 | 18 | (2) are alleged to have been committed in connection | |
19 | 19 | with: | |
20 | 20 | (A) an election for or the holding of state | |
21 | 21 | office; or | |
22 | 22 | (B) an election on a constitutional amendment. | |
23 | 23 | SECTION 2. The constitutional amendment proposed by this | |
24 | 24 | resolution shall be submitted to the voters at the general election | |
25 | 25 | to be held November 3, 2009. The ballot shall be printed to permit | |
26 | 26 | voting for or against the proposition: "The constitutional | |
27 | 27 | amendment permitting the attorney general to prosecute offenses | |
28 | 28 | that arise under the campaign finance laws of this state and that | |
29 | 29 | are alleged to have been committed in connection with a state office | |
30 | 30 | or an election on a constitutional amendment." |
