| 11 | 11 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 1-m, Article VIII, Texas Constitution, |
|---|
| 13 | 13 | | is amended to read as follows: |
|---|
| 14 | 14 | | Sec. 1-m. The legislature by general law may exempt |
|---|
| 15 | 15 | | [authorize a taxing unit to grant an exemption or other relief] from |
|---|
| 16 | 16 | | ad valorem taxes the portion of the assessed value of [on] property |
|---|
| 17 | 17 | | attributable to the implementation on the property of [which] a |
|---|
| 18 | 18 | | rainwater harvesting or other water conservation initiative, |
|---|
| 19 | 19 | | desalination project, or brush control initiative [has been |
|---|
| 20 | 20 | | implemented]. |
|---|
| 21 | 21 | | SECTION 2. The following temporary provision is added to |
|---|
| 22 | 22 | | the Texas Constitution: |
|---|
| 23 | 23 | | TEMPORARY PROVISION. (a) This temporary provision applies to |
|---|
| 24 | 24 | | the constitutional amendment proposed by the 81st Legislature, |
|---|
| 25 | 25 | | Regular Session, 2009, authorizing the legislature to exempt from |
|---|
| 26 | 26 | | ad valorem taxes the portion of the assessed value of property |
|---|
| 27 | 27 | | attributable to the implementation on the property of a water |
|---|
| 28 | 28 | | conservation initiative, desalination project, or brush control |
|---|
| 29 | 29 | | initiative. |
|---|
| 30 | 30 | | (b) The amendment to Section 1-m, Article VIII, of this |
|---|
| 31 | 31 | | constitution takes effect January 1, 2010, and applies only to ad |
|---|
| 32 | 32 | | valorem taxes imposed for a tax year beginning on or after that |
|---|
| 33 | 33 | | date. |
|---|
| 34 | 34 | | (c) This temporary provision expires January 1, 2011. |
|---|
| 35 | 35 | | SECTION 3. This proposed constitutional amendment shall be |
|---|
| 36 | 36 | | submitted to the voters at an election to be held November 3, 2009. |
|---|
| 37 | 37 | | The ballot shall be printed to permit voting for or against the |
|---|
| 38 | 38 | | proposition: "The constitutional amendment to authorize the |
|---|
| 39 | 39 | | legislature by general law to exempt from ad valorem taxes the |
|---|
| 40 | 40 | | portion of the assessed value of property attributable to the |
|---|
| 41 | 41 | | implementation on the property of a water conservation initiative, |
|---|
| 42 | 42 | | desalination project, or brush control initiative." |
