55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing garnishment of
77 wages for court-ordered restitution in a criminal judgment.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 28, Article XVI, Texas Constitution, is
1010 amended to read as follows:
1111 Sec. 28. No current wages for personal service shall ever
1212 be subject to garnishment, except for the enforcement of
1313 court-ordered:
1414 (1) child support payments; [or]
1515 (2) spousal maintenance; or
1616 (3) restitution in a criminal judgment.
1717 SECTION 2. This proposed constitutional amendment shall be
1818 submitted to the voters at an election to be held November 3, 2009.
1919 The ballot shall be printed to permit voting for or against the
2020 proposition: "The constitutional amendment authorizing
2121 garnishment of wages for court-ordered restitution in a criminal
2222 judgment."
