8 | 8 | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 28, Article XVI, Texas Constitution, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Sec. 28. No current wages for personal service shall ever | |
12 | 12 | be subject to garnishment, except for the enforcement of | |
13 | 13 | court-ordered: | |
14 | 14 | (1) child support payments; [or] | |
15 | 15 | (2) spousal maintenance; or | |
16 | 16 | (3) restitution in a criminal judgment. | |
17 | 17 | SECTION 2. This proposed constitutional amendment shall be | |
18 | 18 | submitted to the voters at an election to be held November 3, 2009. | |
19 | 19 | The ballot shall be printed to permit voting for or against the | |
20 | 20 | proposition: "The constitutional amendment authorizing | |
21 | 21 | garnishment of wages for court-ordered restitution in a criminal | |
22 | 22 | judgment." |
