44 A JOINT RESOLUTION
55 proposing a constitutional amendment requiring the state to treat
66 recognized Indian tribes equally with regard to authorizing
77 gambling or other gaming activity on tribal land.
88 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 47, Article III, Texas Constitution, is
1010 amended by amending Subsection (a) and adding Subsection (f) to
1111 read as follows:
1212 (a) The Legislature shall pass laws prohibiting lotteries
1313 and gift enterprises in this State other than those authorized by
1414 Subsections (b), (d), [and] (e), and (f) of this section.
1515 (f) No law of this State, including Subsection (a) of this
1616 section, may be applied or construed to prohibit a federally
1717 recognized Indian tribe from conducting any type of gambling or
1818 other gaming activity on lands held in trust by the United States in
1919 El Paso County, Texas for the benefit Ysleta del Sur Pueblo, a
2020 federally recognized Indian tribe, and lands held in trust by the
2121 United States, in Polk County, Texas for the benefit of the
2222 Alabama-Coushatta Tribe, a federally recognized Indian tribe that
2323 another federally recognized Indian tribe that owns or controls
2424 federally recognized tribal land in this State is authorized by
2525 state or federal law to conduct on that tribal land.
2626 SECTION 2. This proposed constitutional amendment shall be
2727 submitted to the voters at an election to be held November 3, 2009.
2828 The ballot shall be printed to permit voting for or against the
2929 proposition: "The constitutional amendment requiring the State of
3030 Texas to treat recognized Indian tribes equally with regard to
3131 authorizing gambling and other gaming activity on tribal land."
