44 A JOINT RESOLUTION
55 proposing a constitutional amendment authorizing transporting out
66 of this state a noncitizen who commits an offense in this state.
77 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 20, Article I, Texas Constitution, is
99 amended to read as follows:
1010 Sec. 20. No citizen shall be outlawed. No citizen or legal
1111 resident [person] shall be transported out of the State for any
1212 offense committed within the State [same]. This section does not
1313 prohibit an agreement with another state providing for the
1414 confinement of inmates of this State in the penal or correctional
1515 facilities of that state.
1616 SECTION 2. This proposed constitutional amendment shall be
1717 submitted to the voters at an election to be held November 3, 2009.
1818 The ballot shall be printed to permit voting for or against the
1919 proposition: "The constitutional amendment authorizing
2020 transporting out of this state a noncitizen who commits an offense
2121 in this state."
