|---|

| 10 | 10 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 47, Article III, Texas Constitution, is |
|---|
| 12 | 12 | | amended by amending Subsection (a) and adding Subsection (f) to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) The Legislature shall pass laws prohibiting lotteries |
|---|
| 15 | 15 | | and gift enterprises in this State other than those authorized by |
|---|
| 16 | 16 | | Subsections (b), (d), [and] (e), and (f) of this section. |
|---|
| 17 | 17 | | (f) The Legislature by general law may authorize and |
|---|
| 18 | 18 | | regulate the conduct of one or more types of gaming in this State. A |
|---|
| 19 | 19 | | law enacted under this subsection must require that, before any |
|---|
| 20 | 20 | | type of gaming not otherwise permitted by law to be conducted in a |
|---|
| 21 | 21 | | particular county may be conducted in that county, an election must |
|---|
| 22 | 22 | | be held to allow the qualified voters of the county to determine by |
|---|
| 23 | 23 | | a majority vote whether that type of gaming may be legally conducted |
|---|
| 24 | 24 | | in the county. |
|---|
| 25 | 25 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 26 | 26 | | submitted to the voters at an election to be held November 3, 2009. |
|---|
| 27 | 27 | | The ballot shall be printed to permit voting for or against the |
|---|
| 28 | 28 | | proposition: "The constitutional amendment authorizing the |
|---|
| 29 | 29 | | legislature to legalize and regulate the conduct of gaming in this |
|---|
| 30 | 30 | | state in counties that by local option election approve the conduct |
|---|
| 31 | 31 | | of that gaming." |
