55 A JOINT RESOLUTION
66 proposing a constitutional amendment authorizing the legislature
77 to legalize and regulate the conduct of gaming in this state in
88 counties that by local option election approve the conduct of that
99 gaming.
1010 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 47, Article III, Texas Constitution, is
1212 amended by amending Subsection (a) and adding Subsection (f) to
1313 read as follows:
1414 (a) The Legislature shall pass laws prohibiting lotteries
1515 and gift enterprises in this State other than those authorized by
1616 Subsections (b), (d), [and] (e), and (f) of this section.
1717 (f) The Legislature by general law may authorize and
1818 regulate the conduct of one or more types of gaming in this State. A
1919 law enacted under this subsection must require that, before any
2020 type of gaming not otherwise permitted by law to be conducted in a
2121 particular county may be conducted in that county, an election must
2222 be held to allow the qualified voters of the county to determine by
2323 a majority vote whether that type of gaming may be legally conducted
2424 in the county.
2525 SECTION 2. This proposed constitutional amendment shall be
2626 submitted to the voters at an election to be held November 3, 2009.
2727 The ballot shall be printed to permit voting for or against the
2828 proposition: "The constitutional amendment authorizing the
2929 legislature to legalize and regulate the conduct of gaming in this
3030 state in counties that by local option election approve the conduct
3131 of that gaming."
