5	5	BE IT RESOLVED by the House of Representatives of the State of
6	6	Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
7	7	Section 9(a), be suspended in part as provided by House Rule 13,
8	8	Section 9(f), to enable the conference committee appointed to
9	9	resolve the differences on House Bill 2330, laboratory tests
10	10	measuring kidney function, to consider and take action on the
11	11	following matter:
12	12	House Rule 13, Sections 9(a)(3) and (4), are suspended to
13	13	permit the committee to add text to added Section 42.0047, Health
14	14	and Safety Code, so that it reads as follows:
15	15	Sec. 42.0047. ESTIMATED GLOMERULAR FILTRATION RATE
16	16	REPORTING. (a) A laboratory that performs a serum creatinine test
17	17	on a sample from a person 18 years of age or older shall also
18	18	calculate and include in the reported results the person's
19	19	estimated glomerular filtration rate or the results of an
20	20	alternative equivalent calculation measuring kidney function if
21	21	the laboratory receives along with the sample all relevant clinical
22	22	information about the person necessary to calculate the person's
23	23	estimated glomerular filtration rate or perform an alternative
24	24	equivalent calculation. A physician requesting a serum creatinine
25	25	test shall provide to the laboratory all relevant clinical
26	26	information about the person necessary to calculate the person's
27	27	estimated glomerular filtration rate or perform an alternative
28	28	equivalent calculation unless the physician determines that the
29	29	calculation is unnecessary.
30	30	(b) The requirements under Subsection (a) do not apply to:
31	31	(1) a laboratory that uses equipment to perform serum
32	32	creatinine tests that cannot be reprogrammed to calculate the
33	33	estimated glomerular filtration rate or perform an alternative
34	34	equivalent calculation measuring kidney function; or
35	35	(2) a laboratory performing a serum creatinine test on
36	36	a sample taken from a patient who is being treated in a hospital.
37	37	Explanation: This change is necessary to allow a laboratory
38	38	to perform an alternative equivalent calculation measuring a
39	39	person's kidney function.
