55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
77 Section 9(a), be suspended in part as provided by House Rule 13,
88 Section 9(f), to enable the conference committee appointed to
99 resolve the differences on House Bill 2330, laboratory tests
1010 measuring kidney function, to consider and take action on the
1111 following matter:
1212 House Rule 13, Sections 9(a)(3) and (4), are suspended to
1313 permit the committee to add text to added Section 42.0047, Health
1414 and Safety Code, so that it reads as follows:
1515 Sec. 42.0047. ESTIMATED GLOMERULAR FILTRATION RATE
1616 REPORTING. (a) A laboratory that performs a serum creatinine test
1717 on a sample from a person 18 years of age or older shall also
1818 calculate and include in the reported results the person's
1919 estimated glomerular filtration rate or the results of an
2020 alternative equivalent calculation measuring kidney function if
2121 the laboratory receives along with the sample all relevant clinical
2222 information about the person necessary to calculate the person's
2323 estimated glomerular filtration rate or perform an alternative
2424 equivalent calculation. A physician requesting a serum creatinine
2525 test shall provide to the laboratory all relevant clinical
2626 information about the person necessary to calculate the person's
2727 estimated glomerular filtration rate or perform an alternative
2828 equivalent calculation unless the physician determines that the
2929 calculation is unnecessary.
3030 (b) The requirements under Subsection (a) do not apply to:
3131 (1) a laboratory that uses equipment to perform serum
3232 creatinine tests that cannot be reprogrammed to calculate the
3333 estimated glomerular filtration rate or perform an alternative
3434 equivalent calculation measuring kidney function; or
3535 (2) a laboratory performing a serum creatinine test on
3636 a sample taken from a patient who is being treated in a hospital.
3737 Explanation: This change is necessary to allow a laboratory
3838 to perform an alternative equivalent calculation measuring a
3939 person's kidney function.
