44 R E S O L U T I O N
55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
77 Section 9(a), be suspended in part as provided by House Rule 13,
88 Section 9(f), to enable the conference committee appointed to
99 resolve the differences on House Bill 2571 (the licensing and
1010 regulation of towing companies and vehicle storage facilities) to
1111 consider and take action on the following matters:
1212 (1) House Rule 13, Section 9(a)(2), is suspended to permit
1313 the committee to omit text not in disagreement in proposed Section
1414 2303.155(h), Occupations Code, to read as follows:
1515 (h) The operator of a vehicle storage facility or
1616 governmental vehicle storage facility may not charge a fee under
1717 Subsection (b) to the owner of a vehicle stored or parked at the
1818 facility as a result of recovery of the vehicle after being stolen
1919 if the vehicle owner provides the operator with a copy of the police
2020 report or similar report prepared by any law enforcement agency
2121 showing that the vehicle was reported stolen.
2222 Explanation: This change is necessary to remove the
2323 prohibition on certain fees.
2424 (2) House Rule 13, Section 9(a)(4), is suspended to permit
2525 the committee to add text not included in either the house or senate
2626 version of the bill by adding amended Section 2308.208, Occupations
2727 Code, to read as follows:
2828 SECTION 8. Section 2308.208, Occupations Code, is amended
2929 to read as follows:
3030 Sec. 2308.208. MUNICIPAL OR COUNTY ORDINANCE REGULATING
3131 UNAUTHORIZED VEHICLES. The governing body of a [A] municipality or
3232 the commissioners court of a county may adopt an ordinance that is
3333 identical to this chapter or that imposes additional requirements
3434 that exceed the minimum standards of this chapter but may not adopt
3535 an ordinance conflicting with this chapter.
3636 Explanation: This change is necessary to authorize counties
3737 to adopt ordinances regulating unauthorized vehicles and towing of
3838 motor vehicles.
