44 R E S O L U T I O N
55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
77 Section 9(a), be suspended in part as provided by House Rule 13,
88 Section 9(f), to enable the conference committee appointed to
99 resolve the differences on Senate Bill 1263 (certain mass transit
1010 entities) to consider and take action on the following matters:
1111 (1) House Rule 13, Sections 9(a)(1) and (4), are suspended
1212 to permit the committee to change text not in disagreement and add
1313 text not included in either version of the bill under Section 7 of
1414 the bill in amended Section 451.5021(b)(2), Transportation Code, to
1515 read as follows:
1616 (2) two members, one who must be and one who may be an
1717 elected official, [two members] appointed by the governing body of
1818 the principal municipality;
1919 Explanation: The change is necessary because of the two
2020 members of the board appointed by the municipality, only one must be
2121 an elected official.
2222 (2) House Rule 13, Sections 9(a)(1) and (2), are suspended
2323 to permit the committee to change and omit text not in disagreement
2424 in Section 7 of the bill in amended Sections 451.5021(b)(3) and
2525 (b)(4), Transportation Code, so that the text reads as follows:
2626 (3) one member appointed by the commissioners court of
2727 the principal county;
2828 (4) one member appointed by the commissioners court of
2929 the county, excluding the principal county, that has the largest
3030 population of the counties in the authority [a panel composed of the
3131 mayors of all the municipalities in the authority located in the
3232 principal county of the authority, excluding the mayor of the
3333 principal municipality]; [and]
3434 Explanation: The alteration of text is necessary because the
3535 members under these subdivisions will not be jointly appointed.
3636 (3) House Rule 13, Sections 9(a)(1) and (4), are suspended
3737 to permit the committee to change text not in disagreement and add
3838 text not included in either version of the bill in Section 7 of the
3939 bill in the introduction of amended Section 451.5021(d),
4040 Transportation Code, so that it reads as follows:
4141 (d) A person appointed under Subsection (b)(1), (2)
4242 [(b)(2), (3), (4)], or (5), except as provided by Subsection
4343 (b)(2):
4444 Explanation: The new text is needed to refer to the exception
4545 to this subsection under Subsection (b)(2).
4646 (4) House Rule 13, Sections 9(a)(1) and (2), are suspended
4747 to permit the committee to change and omit text not in disagreement
4848 in Section 7 of the bill, in added Sections 451.5021(d-2) and (d-3),
4949 Transportation Code, so that the text reads as follows:
5050 (d-2) A person appointed under Subsection (b)(3) must:
5151 (1) have the person's principal place of occupation or
5252 employment in the portion of the authority's service area that is
5353 located in the principal county; or
5454 (2) be a qualified voter of the principal county.
5555 (d-3) A person appointed under Subsection (b)(4) must:
5656 (1) have the person's principal place of occupation or
5757 employment in the portion of the authority's service area that is
5858 located in the county, other than the principal county, that has the
5959 largest population of the counties in the authority; or
6060 (2) be a qualified voter of the county, other than the
6161 principal county, that has the largest population of the counties
6262 in the authority.
6363 Explanation: The changes delete text that was in error or
6464 that is not necessary because of the change from joint appointments
6565 under Subsections (b)(3) and (b)(4).
