5	5	BE IT RESOLVED by the House of Representatives of the State of
6	6	Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
7	7	Section 9(a), be suspended in part as provided by House Rule 13,
8	8	Section 9(f), to enable the conference committee appointed to
9	9	resolve the differences on Senate Bill 1263 (certain mass transit
10	10	entities) to consider and take action on the following matters:
11	11	(1) House Rule 13, Sections 9(a)(1) and (4), are suspended
12	12	to permit the committee to change text not in disagreement and add
13	13	text not included in either version of the bill under Section 7 of
14	14	the bill in amended Section 451.5021(b)(2), Transportation Code, to
15	15	read as follows:
16	16	(2) two members, one who must be and one who may be an
17	17	elected official, [two members] appointed by the governing body of
18	18	the principal municipality;
19	19	Explanation: The change is necessary because of the two
20	20	members of the board appointed by the municipality, only one must be
21	21	an elected official.
22	22	(2) House Rule 13, Sections 9(a)(1) and (2), are suspended
23	23	to permit the committee to change and omit text not in disagreement
24	24	in Section 7 of the bill in amended Sections 451.5021(b)(3) and
25	25	(b)(4), Transportation Code, so that the text reads as follows:
26	26	(3) one member appointed by the commissioners court of
27	27	the principal county;
28	28	(4) one member appointed by the commissioners court of
29	29	the county, excluding the principal county, that has the largest
30	30	population of the counties in the authority [a panel composed of the
31	31	mayors of all the municipalities in the authority located in the
32	32	principal county of the authority, excluding the mayor of the
33	33	principal municipality]; [and]
34	34	Explanation: The alteration of text is necessary because the
35	35	members under these subdivisions will not be jointly appointed.
36	36	(3) House Rule 13, Sections 9(a)(1) and (4), are suspended
37	37	to permit the committee to change text not in disagreement and add
38	38	text not included in either version of the bill in Section 7 of the
39	39	bill in the introduction of amended Section 451.5021(d),
40	40	Transportation Code, so that it reads as follows:
41	41	(d) A person appointed under Subsection (b)(1), (2)
42	42	[(b)(2), (3), (4)], or (5), except as provided by Subsection
43	43	(b)(2):
44	44	Explanation: The new text is needed to refer to the exception
45	45	to this subsection under Subsection (b)(2).
46	46	(4) House Rule 13, Sections 9(a)(1) and (2), are suspended
47	47	to permit the committee to change and omit text not in disagreement
48	48	in Section 7 of the bill, in added Sections 451.5021(d-2) and (d-3),
49	49	Transportation Code, so that the text reads as follows:
50	50	(d-2) A person appointed under Subsection (b)(3) must:
51	51	(1) have the person's principal place of occupation or
52	52	employment in the portion of the authority's service area that is
53	53	located in the principal county; or
54	54	(2) be a qualified voter of the principal county.
55	55	(d-3) A person appointed under Subsection (b)(4) must:
56	56	(1) have the person's principal place of occupation or
57	57	employment in the portion of the authority's service area that is
58	58	located in the county, other than the principal county, that has the
59	59	largest population of the counties in the authority; or
60	60	(2) be a qualified voter of the county, other than the
61	61	principal county, that has the largest population of the counties
62	62	in the authority.
63	63	Explanation: The changes delete text that was in error or
64	64	that is not necessary because of the change from joint appointments
65	65	under Subsections (b)(3) and (b)(4).
