55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
77 Section 9(a), be suspended in part as provided by House Rule 13,
88 Section 9(f), to enable the conference committee appointed to
99 resolve the differences on House Bill 3347 (plan qualification
1010 provisions for and certain supplemental payments and health
1111 insurance deductions under the Teacher Retirement System of Texas)
1212 to consider and take action on the following matter:
1313 House Rule 13, Section 9(a)(4), is suspended to permit the
1414 committee to add the following new SECTION 5 to the bill:
1515 SECTION 5. (a) The Teacher Retirement System of Texas
1616 shall make a one-time supplemental payment of a retirement or death
1717 benefit as provided by this section.
1818 (b) The supplemental payment is payable to each eligible
1919 annuitant not later than January 2010 and, to the extent
2020 practicable, on a date or dates that coincide with the regular
2121 annuity payment payable to each eligible annuitant.
2222 (c) The amount of the supplemental payment is equal to the
2323 lesser of:
2424 (1) the gross amount of the regular annuity payment to
2525 which the eligible annuitant is otherwise entitled for the month of
2626 December 2009; or
2727 (2) $500.
2828 (d) The supplemental payment is payable without regard to
2929 any forfeiture of benefits under Section 824.601, Government Code.
3030 The Teacher Retirement System of Texas shall make applicable tax
3131 withholding and other legally required deductions before
3232 disbursing the supplemental payment. A supplemental payment under
3333 this section is in addition to and not in lieu of the regular
3434 monthly annuity payment to which the eligible annuitant is
3535 otherwise entitled.
3636 (e) Subject to Subsection (f) of this section, to be
3737 eligible for the supplemental payment, a person must be, for the
3838 month of December 2009, and disregarding any forfeiture of benefits
3939 under Section 824.601, Government Code, an annuitant eligible to
4040 receive:
4141 (1) a standard retirement annuity payment;
4242 (2) an optional retirement annuity payment as either a
4343 retiree or beneficiary;
4444 (3) a life annuity payment under Section
4545 824.402(a)(4), Government Code;
4646 (4) an annuity for a guaranteed period of 60 months
4747 under Section 824.402(a)(3), Government Code; or
4848 (5) an alternate payee annuity payment under Section
4949 804.005, Government Code.
5050 (f) If the annuitant is a retiree or if the annuitant is a
5151 beneficiary of a retiree who selected an optional retirement
5252 payment plan, to be eligible for the supplemental payment, the
5353 effective date of the retirement of the member of the Teacher
5454 Retirement System of Texas must have been on or before December 31,
5555 2008. If the annuitant is a beneficiary under Section
5656 824.402(a)(3) or (4), Government Code, to be eligible for the
5757 supplemental payment, the date of death of the member of the
5858 retirement system must have been on or before December 31, 2008.
5959 The supplemental payment shall be made to an alternate payee who is
6060 an annuitant under Section 804.005, Government Code, only if the
6161 annuity payment to the alternate payee commenced on or before
6262 December 31, 2008. The supplemental payment is in addition to the
6363 guaranteed number of payments under Section 824.402(a)(3),
6464 Government Code, Section 824.204(c)(3) or (4), Government Code, or
6565 Section 824.308(c)(3) or (4), Government Code, and may not be
6666 counted as one of the guaranteed monthly payments.
6767 (g) The supplemental payment does not apply to payments
6868 under:
6969 (1) Section 824.304(a), Government Code, relating to
7070 disability retirees with less than 10 years of service credit;
7171 (2) Section 824.804(b), Government Code, relating to
7272 participants in the deferred retirement option plan with regard to
7373 payments from their deferred retirement option plan accounts;
7474 (3) Section 824.501(a), Government Code, relating to
7575 retiree survivor beneficiaries who receive a survivor annuity in an
7676 amount fixed by statute; or
7777 (4) Section 824.404(a), Government Code, relating to
7878 active member survivor beneficiaries who receive a survivor annuity
7979 in an amount fixed by statute.
8080 (h) Except as provided by this section, the board of
8181 trustees of the Teacher Retirement System of Texas shall determine
8282 the eligibility for and the amount and timing of a supplemental
8383 payment and the manner in which the payment is made.
8484 (i) The supplemental payment is contingent on sufficient
8585 funds being appropriated from general revenue to the Teacher
8686 Retirement System of Texas for this purpose and may not be paid from
8787 trust funds.
8888 Explanation: This addition is necessary to provide a
8989 supplemental payment to eligible retirees and beneficiaries who
9090 receive payments from the Teacher Retirement System of Texas.
