28 | 28 | | Sec. 46.102. ENERGY EFFICIENCY AND CONSERVATION STANDARDS |
---|
29 | 29 | | FOR INSTRUCTIONAL FACILITIES. (a) In this section, "energy |
---|
30 | 30 | | office" means the State Energy Conservation Office. |
---|
31 | 31 | | (b) The energy office shall adopt energy efficiency and |
---|
32 | 32 | | conservation standards for the design, construction, and major |
---|
33 | 33 | | renovation of instructional facilities that school districts may |
---|
34 | 34 | | adopt or use to achieve long-term savings in energy and water costs |
---|
35 | 35 | | through innovative building techniques. |
---|
36 | 36 | | (c) The standards adopted under Subsection (b) must match |
---|
37 | 37 | | high-performance building certification standards that: |
---|
38 | 38 | | (1) are developed and revised through a |
---|
39 | 39 | | consensus-based process or by a municipally owned utility in this |
---|
40 | 40 | | state; |
---|
41 | 41 | | (2) provide minimum requirements for energy use, |
---|
42 | 42 | | natural resources use, and indoor air quality; |
---|
43 | 43 | | (3) require substantiating documentation for |
---|
44 | 44 | | certification; |
---|
45 | 45 | | (4) employ third-party, post-construction review and |
---|
46 | 46 | | verification for certification; and |
---|
47 | 47 | | (5) the energy office determines are nationally |
---|
48 | 48 | | recognized in the building industry, such as: |
---|
49 | 49 | | (A) the Texas Collaborative for High Performance |
---|
50 | 50 | | Schools (TX-CHPS) Criteria; |
---|
51 | 51 | | (B) the Green Building Initiative's Green Globes |
---|
52 | 52 | | program; |
---|
53 | 53 | | (C) the Leadership in Energy and Environmental |
---|
54 | 54 | | Design (LEED) Green Building Rating System; or |
---|
55 | 55 | | (D) the Austin Energy Green Building Program. |
---|
56 | 56 | | (d) The energy office may update the standards adopted under |
---|
57 | 57 | | this section not more frequently than once every three years. |
---|
58 | 58 | | (e) The energy office shall prepare an analysis of the |
---|
59 | 59 | | typical initial building costs and projected energy and other |
---|
60 | 60 | | savings associated with the implementation of the standards adopted |
---|
61 | 61 | | by the energy office under this section. The office shall publish |
---|
62 | 62 | | the analysis and make copies available to all school districts in |
---|
63 | 63 | | this state. |
---|
64 | 64 | | (f) The energy office shall adopt rules necessary to |
---|
65 | 65 | | administer this section. |
---|
66 | 66 | | Sec. 46.103. STATE AND FEDERAL FUNDS. The energy office |
---|
67 | 67 | | shall, to the extent possible, assist school districts to obtain |
---|
68 | 68 | | state and federal funding for implementing the standards adopted |
---|
69 | 69 | | under this subchapter. |
---|
70 | 70 | | Explanation: The change is necessary to establish energy |
---|
71 | 71 | | efficiency standards and conservation standards for certain school |
---|
72 | 72 | | district facilities. |
---|
73 | 73 | | (3) Rule 13, Section 9(a)(4), is suspended to permit the |
---|
74 | 74 | | committee to add the following: |

75 | 75 | | SECTION 6. Not later than July 1, 2010, the State Energy |
---|
76 | 76 | | Conservation Office shall adopt rules establishing energy |
---|
77 | 77 | | efficiency, conservation, and indoor air quality standards for the |

78 | 78 | | design, construction, and renovation of public school |
---|
79 | 79 | | instructional facilities as required by Section 46.102, Education |
---|
80 | 80 | | Code, as added by this Act. |
