55 BE IT RESOLVED by the House of Representatives of the State of
66 Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
77 Section 9(a), be suspended in part as provided by House Rule 13,
88 Section 9(f), to enable the conference committee appointed to
99 resolve the differences on House Bill 431, (design, construction,
1010 and renovation standards for state buildings and facilities), to
1111 consider and take action on the following matter:
1212 (1) Rule 13, Section 9(a)(4), is suspended to permit the
1313 committee to add the following:
1414 SECTION 3. The heading to Chapter 46, Education Code, is
1515 amended to read as follows:
1616 CHAPTER 46. [ASSISTANCE WITH] INSTRUCTIONAL FACILITIES AND
1717 ASSISTANCE WITH PAYMENT OF EXISTING DEBT
1818 Explanation: The change is necessary to change the heading
1919 of Chapter 46, Education Code.
2020 (2) Rule 13, Section 9(a)(4), is suspended to permit the
2121 committee to add the following:
2222 SECTION 4. Chapter 46, Education Code, is amended by adding
2323 Subchapter D to read as follows:
2424 SUBCHAPTER D. STANDARDS FOR INSTRUCTIONAL FACILITIES
2525 Sec. 46.101. DEFINITION. In this subchapter,
2626 "instructional facility" has the meaning assigned by Section
2727 46.001.
2828 Sec. 46.102. ENERGY EFFICIENCY AND CONSERVATION STANDARDS
2929 FOR INSTRUCTIONAL FACILITIES. (a) In this section, "energy
3030 office" means the State Energy Conservation Office.
3131 (b) The energy office shall adopt energy efficiency and
3232 conservation standards for the design, construction, and major
3333 renovation of instructional facilities that school districts may
3434 adopt or use to achieve long-term savings in energy and water costs
3535 through innovative building techniques.
3636 (c) The standards adopted under Subsection (b) must match
3737 high-performance building certification standards that:
3838 (1) are developed and revised through a
3939 consensus-based process or by a municipally owned utility in this
4040 state;
4141 (2) provide minimum requirements for energy use,
4242 natural resources use, and indoor air quality;
4343 (3) require substantiating documentation for
4444 certification;
4545 (4) employ third-party, post-construction review and
4646 verification for certification; and
4747 (5) the energy office determines are nationally
4848 recognized in the building industry, such as:
4949 (A) the Texas Collaborative for High Performance
5050 Schools (TX-CHPS) Criteria;
5151 (B) the Green Building Initiative's Green Globes
5252 program;
5353 (C) the Leadership in Energy and Environmental
5454 Design (LEED) Green Building Rating System; or
5555 (D) the Austin Energy Green Building Program.
5656 (d) The energy office may update the standards adopted under
5757 this section not more frequently than once every three years.
5858 (e) The energy office shall prepare an analysis of the
5959 typical initial building costs and projected energy and other
6060 savings associated with the implementation of the standards adopted
6161 by the energy office under this section. The office shall publish
6262 the analysis and make copies available to all school districts in
6363 this state.
6464 (f) The energy office shall adopt rules necessary to
6565 administer this section.
6666 Sec. 46.103. STATE AND FEDERAL FUNDS. The energy office
6767 shall, to the extent possible, assist school districts to obtain
6868 state and federal funding for implementing the standards adopted
6969 under this subchapter.
7070 Explanation: The change is necessary to establish energy
7171 efficiency standards and conservation standards for certain school
7272 district facilities.
7373 (3) Rule 13, Section 9(a)(4), is suspended to permit the
7474 committee to add the following:
7575 SECTION 6. Not later than July 1, 2010, the State Energy
7676 Conservation Office shall adopt rules establishing energy
7777 efficiency, conservation, and indoor air quality standards for the
7878 design, construction, and renovation of public school
7979 instructional facilities as required by Section 46.102, Education
8080 Code, as added by this Act.
8181 Explanation: The change is necessary to implement the energy
8282 efficiency standards and conservation standards for certain school
8383 district facilities.
