 R E S O L U T I O N
 BE IT RESOLVED by the House of Representatives of the State of
 Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
 Section 9(a), be suspended in part as provided by House Rule 13,
 Section 9(f), to enable the conference committee appointed to
 resolve the differences on Senate Bill 726 (the creation of the
 Harrison County and Prairielands Groundwater Conservation
 Districts, providing authority to impose a tax and issue bonds and
 granting a limited power of eminent domain) to consider and take
 action on the following matter:
 House Rule 13, Section 9(a)(2), is suspended to permit the
 committee to omit text not in disagreement in proposed Section
 8850.005, Special District Local Laws Code, in both versions of the
 bill, that reads as follows:
 Sec. 8850.005.  DISTRICT TERRITORY REQUIREMENTS;
 DISSOLUTION OF DISTRICT. (a) On September 1, 2013, the district
 boundaries must include at least one county adjacent to Harrison
 County.
 (b)  As soon as practicable after September 1, 2013, the
 Texas Commission on Environmental Quality shall determine whether
 the district complies with Subsection (a).
 (c)  If the commission determines that the district does not
 comply with Subsection (a), the commission shall dissolve the
 district in accordance with Sections 36.304, 36.305, 36.307,
 36.308, 36.309, and 36.310, Water Code, regardless of whether the
 district meets the criteria for dissolution under Section
 36.304(a), Water Code.
 (d) This section expires September 1, 2015.
 Explanation: The omission is necessary because this
 provision is not essential to the creation, duties, or powers of the
 district.
