5 | 5 | | BE IT RESOLVED by the House of Representatives of the State of |

6 | 6 | | Texas, That, in accordance with Sections 9(b) and 11, Article III, |
---|
7 | 7 | | Texas Constitution, the House of Representatives of the 81st |
---|
8 | 8 | | Legislature shall receive nominations to elect a speaker of the |
---|
9 | 9 | | house from its own membership as follows: |
---|
10 | 10 | | SECTION 1. NOMINATIONS. (a) The secretary of state shall |
---|
11 | 11 | | call for nominations from the floor for the election of speaker of |
---|
12 | 12 | | the house of representatives and shall recognize every member who |
---|
13 | 13 | | desires to make a nomination. The order in which members desiring |
---|
14 | 14 | | to make a nomination shall proceed shall be determined by lot. |
---|
15 | 15 | | (b) Each member recognized for this purpose shall |
---|
16 | 16 | | immediately advance to the front microphone and make the nomination |
---|
17 | 17 | | in a nominating speech not to exceed five minutes in length. |
---|
18 | 18 | | (c) After all nominations have been made, the secretary of |
---|
19 | 19 | | state shall declare nominations to be closed. |
---|
20 | 20 | | (d) The secretary of state shall recognize at any time a |
---|
21 | 21 | | member whose name has been placed in nomination for the purpose of |
---|
22 | 22 | | withdrawing as a nominee. A member who withdraws is not considered |
---|
23 | 23 | | a nominee. |
---|
24 | 24 | | SECTION 2. SECONDS. (a) A person is not considered a |
---|
25 | 25 | | nominee unless the nomination is seconded by at least one member. |
---|
26 | 26 | | (b) One seconding speech shall be allowed for each |
---|
27 | 27 | | nomination in the order in which nominations were made, then other |
---|
28 | 28 | | seconding speeches shall be allowed in rotation in the same order. |
---|
29 | 29 | | (c) No more than five seconding speeches shall be allowed |
---|
30 | 30 | | for each nominee. |
---|
31 | 31 | | (d) A seconding speech may not exceed three minutes in |
---|
32 | 32 | | length. |
---|
33 | 33 | | SECTION 3. MOTION TO ELECT BY ACCLAMATION. If after the |
---|
34 | 34 | | close of all seconding speeches only one member's name remains in |
---|
35 | 35 | | nomination for election to speaker of the house of representatives, |
---|
36 | 36 | | the secretary of state shall recognize a motion to elect that member |
---|
37 | 37 | | as speaker by acclamation. |
---|
38 | 38 | | SECTION 4. OATH. If a speaker is elected by acclamation, |
---|
39 | 39 | | the secretary of state shall direct the administration of the oath |
---|
40 | 40 | | of office to the speaker-elect. The speaker shall take the chair |
---|
41 | 41 | | immediately after taking the oath of office. |
