| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 2253.001(b), Insurance Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (b) The commissioner by rule may allow a greater rate | |
| 13 | 13 | difference than the rate difference specified by Subsection (a) | |
| 14 | 14 | only if the commissioner determines that the greater rate | |
| 15 | 15 | difference is justified solely by weather-related factors and is | |
| 16 | 16 | supported with sound actuarial data. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies only | |
| 18 | 18 | to a residential property or personal automobile insurance policy | |
| 19 | 19 | delivered, issued for delivery, or renewed on or after January 1, | |
| 20 | 20 | 2010. A policy delivered, issued for delivery, or renewed before | |
| 21 | 21 | January 1, 2010, is governed by the law in effect immediately before | |
| 22 | 22 | the effective date of this Act, and that law is continued in effect | |
| 23 | 23 | for that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2009. |
