| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 551.009, Health and |
|---|
| 11 | 11 | | Safety Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 551.009. HILL COUNTRY LOCAL MENTAL HEALTH AUTHORITY |
|---|
| 13 | 13 | | CRISIS STABILIZATION UNIT [PILOT PROJECT]. |
|---|
| 14 | 14 | | SECTION 2. Sections 551.009(a), (c), and (e), Health and |
|---|
| 15 | 15 | | Safety Code, are amended to read as follows: |
|---|
| 16 | 16 | | (a) The Department of State Health Services shall operate |
|---|
| 17 | 17 | | [implement a crisis stabilization unit pilot project by |
|---|
| 18 | 18 | | establishing and operating] a crisis stabilization unit on the |
|---|
| 19 | 19 | | grounds of the Kerrville State Hospital as provided by this |
|---|
| 20 | 20 | | section. The unit must be a 16-bed facility separate from the |
|---|
| 21 | 21 | | buildings used by the Kerrville State Hospital. |
|---|
| 22 | 22 | | (c) The local mental health authority shall contract with |
|---|
| 23 | 23 | | Kerrville State Hospital to provide food service, laundry service, |
|---|
| 24 | 24 | | and lawn care[, and equipment rental to the crisis stabilization |
|---|
| 25 | 25 | | unit. The local mental health authority may contract with |
|---|
| 26 | 26 | | Kerrville State Hospital to provide pharmaceutical services for the |
|---|
| 27 | 27 | | crisis stabilization unit]. |
|---|
| 28 | 28 | | (e) The local mental health authority operating the crisis |
|---|
| 29 | 29 | | stabilization unit under contract shall use, for the purpose of |
|---|
| 30 | 30 | | operating the 16-bed unit, the money appropriated to the department |
|---|
| 31 | 31 | | for operating 16 beds in state hospitals that is allocated to the |
|---|
| 32 | 32 | | local mental health authority. The department shall ensure that |
|---|
| 33 | 33 | | the local mental health authority retains the remainder of the |
|---|
| 34 | 34 | | local authority's state hospital allocation that is not used for |
|---|
| 35 | 35 | | operating the 16-bed unit. The department may allocate additional |
|---|
| 36 | 36 | | funds appropriated to the department for state hospitals to the |
|---|
| 37 | 37 | | crisis stabilization unit [pilot project]. |
|---|
| 38 | 38 | | SECTION 3. Sections 551.009(g) and (h), Health and Safety |
|---|
| 39 | 39 | | Code, are repealed. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect August 31, 2009. |
