| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subtitle A, Title 3, Occupations Code, is |
|---|
| 9 | 9 | | amended by adding Chapter 114 to read as follows: |
|---|
| 10 | 10 | | CHAPTER 114. REPORTING REQUIREMENTS APPLICABLE TO MULTIPLE HEALTH |
|---|
| 11 | 11 | | OCCUPATION REGULATORY AGENCIES |
|---|
| 12 | 12 | | Sec. 114.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "Health care practitioner" means an individual |
|---|
| 14 | 14 | | issued a license, certificate, registration, title, permit, or |
|---|
| 15 | 15 | | other authorization to engage in a health care profession. |
|---|
| 16 | 16 | | (2) "Health occupation regulatory agency" means a |
|---|
| 17 | 17 | | department, commission, board, office, authority, or other agency |
|---|
| 18 | 18 | | of the state that regulates a health care practitioner under this |
|---|
| 19 | 19 | | title. |
|---|
| 20 | 20 | | Sec. 114.002. ANNUAL REPORT TO LEGISLATURE. (a) Not later |
|---|
| 21 | 21 | | than February 1 of each year, each health occupation regulatory |
|---|
| 22 | 22 | | agency shall file a report with the chairs of the house and senate |
|---|
| 23 | 23 | | committees with primary oversight over the agency that includes the |
|---|
| 24 | 24 | | following: |
|---|
| 25 | 25 | | (1) the number of persons regulated by the agency; |
|---|
| 26 | 26 | | (2) the number of persons who became subject to |
|---|
| 27 | 27 | | regulation by the agency in the previous year; |
|---|
| 28 | 28 | | (3) the number of persons regulated by the agency by |
|---|
| 29 | 29 | | county; |
|---|
| 30 | 30 | | (4) a description of any complaints reported to the |
|---|
| 31 | 31 | | agency or a description of the complaint categories used by the |
|---|
| 32 | 32 | | agency and the number of complaints in each category; |
|---|
| 33 | 33 | | (5) the number of complaints investigated by the |
|---|
| 34 | 34 | | agency and a description of the final resolution of the complaints; |
|---|
| 35 | 35 | | (6) the amount of fees collected by the agency each |
|---|
| 36 | 36 | | year; |
|---|
| 37 | 37 | | (7) the expenses of the agency; and |
|---|
| 38 | 38 | | (8) any unfunded needs of the agency. |
|---|
| 39 | 39 | | (b) The Health Professions Council shall adopt a standard |
|---|
| 40 | 40 | | format that must be used by health occupation regulatory agencies |
|---|
| 41 | 41 | | to report the information required under Subsection (a). |
|---|
| 42 | 42 | | SECTION 2. Not later than January 1, 2010, the Health |
|---|
| 43 | 43 | | Professions Council shall adopt the standard reporting format |
|---|
| 44 | 44 | | required under Subsection (b), Section 114.002, Occupations Code, |
|---|
| 45 | 45 | | as added by this Act. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect September 1, 2009. |
