99 relating to creating an online resource center for individuals
1010 handling child abuse and neglect cases.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 264, Family Code, is amended by adding
1313 Subchapter K to read as follows:
1414 SUBCHAPTER K. ONLINE RESOURCE CENTER
1515 Sec. 264.821. DEFINITIONS. In this subchapter:
1616 (1) "Communications tool" means an online method for
1717 peer-to-peer communication among individuals who handle child
1818 abuse and neglect cases.
1919 (2) "Office" means the Office of Court Administration
2020 of the Texas Judicial System.
2121 (3) "Online resource center" means a single
2222 interactive Internet website that provides, to individuals who
2323 handle child abuse and neglect cases, timely informational
2424 materials pertinent to child abuse and neglect cases in this state,
2525 which may include summaries of Texas cases and statutes relating to
2626 child abuse and neglect, sample briefs and other legal forms,
2727 articles and papers, manuals with information on Texas legal
2828 practice and practice tips, a conference calendar, and
2929 communications tools.
3030 Sec. 264.822. CONTRACT. (a) The office shall contract
3131 with an entity to provide an online resource center if:
3232 (1) the office is specifically appropriated money in
3333 an amount adequate to provide the online resource center; and
3434 (2) there is a qualified entity with whom the office is
3535 able to contract.
3636 (b) The online resource center must:
3737 (1) provide a means of searching for informational
3838 materials by subject; and
3939 (2) include a:
4040 (A) communications tool for judges; and
4141 (B) communications tool for attorneys.
4242 (c) The contract under this section must prohibit the entity
4343 with which the office contracts from spending more than 12 percent
4444 of the contract price on the entity's indirect or administrative
4545 overhead expenses.
4646 (d) If the office does not enter into a contract in
4747 accordance with this subchapter, the office may not receive the
4848 funds appropriated to the office in connection with this
4949 subchapter.
5050 Sec. 264.823. ELIGIBILITY FOR CONTRACT. The entity with
5151 which the office contracts under this subchapter must:
5252 (1) have experience in operating an online resource
5353 center specifically designed for judges and attorneys handling
5454 child abuse and neglect cases in this state;
5555 (2) have experience in providing a communications
5656 tool; and
5757 (3) employ or contract with at least one attorney who
5858 is licensed to practice law in this state and who specializes in
5959 child abuse and neglect cases to compile the materials for and
6060 oversee the operation of the online resource center.
6161 Sec. 264.824. FUNDING. (a) The entity with which the
6262 office contracts under this subchapter may obtain funding from
6363 private foundations and individuals, from state and federal grants,
6464 and from any other source to operate the online resource center.
6565 (b) The entity must maintain and provide to the office
6666 records that adequately identify:
6767 (1) each person who provided funds to the entity to
6868 operate the online resource center; and
6969 (2) the amount of funds the person provided.
7070 Sec. 264.825. CONFIDENTIALITY. All communications
7171 conducted through a communications tool provided in connection with
7272 the online resource center implemented under this subchapter are
7373 privileged and confidential.
7474 SECTION 2. This Act does not make an appropriation. A
7575 provision in this Act that creates a new governmental program,
7676 creates a new entitlement, or imposes a new duty on a governmental
7777 entity is not mandatory during a fiscal period for which the
7878 legislature has not made a specific appropriation to implement the
7979 provision.
8080 SECTION 3. This Act takes effect September 1, 2009.
