A BILL TO BE ENTITLED
AN ACT
relating to the duties of the Texas Department of Insurance.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 31.002, Insurance Code, is amended to
read as follows:
Sec. 31.002. DUTIES OF DEPARTMENT. In addition to the
other duties required of the Texas Department of Insurance, the
department shall:
(1) regulate the business of insurance in this state;
(2) administer the workers' compensation system of
this state as provided by Title 5, Labor Code; [and]
(3) ensure that this code and other laws regarding
insurance and insurance companies are executed; and
(4) promote fair and equitable practices and deter
deceptive practices in the insurance market.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2009.
