77 relating to the screening of newborns for sickle-cell trait and
88 other disorders by the Department of State Health Services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 33, Health and Safety
1111 Code, is amended to read as follows:
1212 CHAPTER 33. PHENYLKETONURIA, OTHER HERITABLE DISEASES,
1313 HYPOTHYROIDISM, AND CERTAIN OTHER DISORDERS OR TRAITS
1414 SECTION 2. Sections 33.002(a) and (c), Health and Safety
1515 Code, are amended to read as follows:
1616 (a) The department shall carry out a program to combat
1717 morbidity, including mental retardation, and mortality in persons
1818 who have phenylketonuria, other heritable diseases, other
1919 disorders for which screening is required by the department,
2020 sickle-cell trait, or hypothyroidism.
2121 (c) The department shall establish and maintain a
2222 laboratory to:
2323 (1) conduct experiments, projects, and other
2424 activities necessary to develop screening or diagnostic tests for
2525 the early detection of phenylketonuria, other heritable diseases,
2626 other disorders for which screening is required by the department,
2727 sickle-cell trait, and hypothyroidism;
2828 (2) develop ways and means or discover methods to be
2929 used to prevent or treat phenylketonuria, other heritable diseases,
3030 other disorders for which screening is required by the department,
3131 sickle-cell trait, and hypothyroidism; and
3232 (3) serve other purposes considered necessary by the
3333 department to carry out the program.
3434 SECTION 3. Section 33.011(a), Health and Safety Code, is
3535 amended to read as follows:
3636 (a) The physician attending a newborn child or the person
3737 attending the delivery of a newborn child that is not attended by a
3838 physician shall subject the child to screening tests approved by
3939 the department for phenylketonuria, other heritable diseases,
4040 hypothyroidism, sickle-cell trait, and other disorders for which
4141 screening is required by the department.
4242 SECTION 4. Section 33.014(a), Health and Safety Code, is
4343 amended to read as follows:
4444 (a) If, because of an analysis of a specimen submitted under
4545 Section 33.011, the department reasonably suspects that a newborn
4646 child may have phenylketonuria, another heritable disease,
4747 hypothyroidism, sickle-cell trait, or another disorder for which
4848 the screening tests are required, the department shall notify the
4949 person who submits the specimen that the results are abnormal and
5050 provide the test results to that person. The department may notify
5151 one or more of the following that the results of the analysis are
5252 abnormal and recommend further testing when necessary:
5353 (1) the physician attending the newborn child or the
5454 physician's designee;
5555 (2) the person attending the delivery of the newborn
5656 child that was not attended by a physician;
5757 (3) the parents of the newborn child;
5858 (4) the health authority of the jurisdiction in which
5959 the newborn child was born or in which the child resides, if known;
6060 or
6161 (5) physicians who are cooperating pediatric
6262 specialists for the program.
6363 SECTION 5. Section 33.031(a), Health and Safety Code, is
6464 amended to read as follows:
6565 (a) All newborn children and other individuals under 21
6666 years of age who have been screened, have been found to be
6767 presumptively positive through the newborn screening program for
6868 phenylketonuria, other heritable diseases, hypothyroidism,
6969 sickle-cell trait, or another disorder for which the screening
7070 tests are required, and may be financially eligible may be referred
7171 to the department's services program for children with special
7272 health care needs.
7373 SECTION 6. Section 33.032(a), Health and Safety Code, is
7474 amended to read as follows:
7575 (a) Within the limits of funds available for this purpose
7676 and in cooperation with the individual's physician, the department
7777 may provide services directly or through approved providers to
7878 individuals of any age who meet the eligibility criteria specified
7979 by board rules on the confirmation of a positive test for
8080 phenylketonuria, other heritable diseases, hypothyroidism,
8181 sickle-cell trait, or another disorder for which the screening
8282 tests are required.
8383 SECTION 7. As soon as practicable after the effective date
8484 of this Act, the Department of State Health Services shall
8585 implement the changes in law made by this Act to the newborn
8686 screening program under Chapter 33, Health and Safety Code.
8787 SECTION 8. This Act takes effect September 1, 2009.
