55 AN ACT
66 relating to the submission of reports on certain convictions or
77 adjudications relating to the operation of motor vehicles to the
88 Department of Public Safety of the State of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsections (a) and (b), Section 522.061,
1111 Transportation Code, are amended to read as follows:
1212 (a) A person who holds or is required to hold a commercial
1313 driver's license under this chapter and who is convicted in another
1414 state of violating a state law or local ordinance relating to motor
1515 vehicle traffic control shall notify the department in the manner
1616 specified by the department not later than the seventh [30th] day
1717 after the date of conviction.
1818 (b) A person who holds or is required to hold a commercial
1919 driver's license under this chapter and who is convicted in this
2020 state or another state of violating a state law or local ordinance
2121 relating to motor vehicle traffic control, including a law
2222 regulating the operation of vehicles on highways, shall notify the
2323 person's employer in writing of the conviction not later than the
2424 seventh [30th] day after the date of conviction.
2525 SECTION 2. Section 543.203, Transportation Code, is amended
2626 to read as follows:
2727 Sec. 543.203. SUBMITTING RECORD TO DEPARTMENT. Not later
2828 than the seventh [30th] day after the date of conviction or
2929 forfeiture of bail of a person on a charge of violating a law
3030 regulating the operation of a vehicle on a highway or conviction of
3131 a person of negligent homicide or a felony in the commission of
3232 which a vehicle was used, the magistrate, judge, or clerk of the
3333 court in which the conviction was had or bail was forfeited shall
3434 immediately submit to the department a written record of the case
3535 containing the information required by Section 543.202.
3636 SECTION 3. Subsection (a), Section 543.204, Transportation
3737 Code, is amended to read as follows:
3838 (a) A justice of the peace or municipal judge who defers
3939 further proceedings, suspends all or part of the imposition of the
4040 fine, and places a defendant on probation under Article 45.051,
4141 Code of Criminal Procedure, or a county court judge who follows that
4242 procedure under Article 42.111, Code of Criminal Procedure, may not
4343 submit a written record to the department, except that if the
4444 justice or judge subsequently adjudicates the defendant's guilt,
4545 the justice or judge shall submit the record not later than the
4646 seventh [30th] day after the date on which the justice or judge
4747 adjudicates guilt.
4848 SECTION 4. The change in law made by this Act applies only
4949 to a conviction, forfeiture of bail, or adjudication of guilt that
5050 occurs on or after the effective date of this Act.
5151 SECTION 5. This Act takes effect September 1, 2009.
