6 | 6 | | relating to the submission of reports on certain convictions or |

7 | 7 | | adjudications relating to the operation of motor vehicles to the |
---|
8 | 8 | | Department of Public Safety of the State of Texas. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsections (a) and (b), Section 522.061, |
---|
11 | 11 | | Transportation Code, are amended to read as follows: |
---|
12 | 12 | | (a) A person who holds or is required to hold a commercial |
---|
13 | 13 | | driver's license under this chapter and who is convicted in another |
---|
14 | 14 | | state of violating a state law or local ordinance relating to motor |
---|
15 | 15 | | vehicle traffic control shall notify the department in the manner |
---|
16 | 16 | | specified by the department not later than the seventh [30th] day |
---|
17 | 17 | | after the date of conviction. |
---|
18 | 18 | | (b) A person who holds or is required to hold a commercial |
---|
19 | 19 | | driver's license under this chapter and who is convicted in this |
---|
20 | 20 | | state or another state of violating a state law or local ordinance |
---|
21 | 21 | | relating to motor vehicle traffic control, including a law |
---|
22 | 22 | | regulating the operation of vehicles on highways, shall notify the |
---|
23 | 23 | | person's employer in writing of the conviction not later than the |
---|
24 | 24 | | seventh [30th] day after the date of conviction. |
---|
25 | 25 | | SECTION 2. Section 543.203, Transportation Code, is amended |
---|
26 | 26 | | to read as follows: |
---|
27 | 27 | | Sec. 543.203. SUBMITTING RECORD TO DEPARTMENT. Not later |
---|
28 | 28 | | than the seventh [30th] day after the date of conviction or |
---|
29 | 29 | | forfeiture of bail of a person on a charge of violating a law |
---|
30 | 30 | | regulating the operation of a vehicle on a highway or conviction of |
---|
31 | 31 | | a person of negligent homicide or a felony in the commission of |
---|
32 | 32 | | which a vehicle was used, the magistrate, judge, or clerk of the |
---|
33 | 33 | | court in which the conviction was had or bail was forfeited shall |
---|
34 | 34 | | immediately submit to the department a written record of the case |
---|
35 | 35 | | containing the information required by Section 543.202. |
---|
36 | 36 | | SECTION 3. Subsection (a), Section 543.204, Transportation |
---|
37 | 37 | | Code, is amended to read as follows: |
---|
38 | 38 | | (a) A justice of the peace or municipal judge who defers |
---|
39 | 39 | | further proceedings, suspends all or part of the imposition of the |
---|
40 | 40 | | fine, and places a defendant on probation under Article 45.051, |
---|
41 | 41 | | Code of Criminal Procedure, or a county court judge who follows that |
---|
42 | 42 | | procedure under Article 42.111, Code of Criminal Procedure, may not |
---|
43 | 43 | | submit a written record to the department, except that if the |
---|
44 | 44 | | justice or judge subsequently adjudicates the defendant's guilt, |
---|
45 | 45 | | the justice or judge shall submit the record not later than the |
---|
46 | 46 | | seventh [30th] day after the date on which the justice or judge |
---|
47 | 47 | | adjudicates guilt. |
---|
48 | 48 | | SECTION 4. The change in law made by this Act applies only |
---|
49 | 49 | | to a conviction, forfeiture of bail, or adjudication of guilt that |
---|
50 | 50 | | occurs on or after the effective date of this Act. |
---|
51 | 51 | | SECTION 5. This Act takes effect September 1, 2009. |
