6	6	AN ACT
7	7	relating to the creation of the XS Ranch Municipal Utility
8	8	District; providing authority to impose a tax and issue bonds;
9	9	granting a limited power of eminent domain.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subtitle F, Title 6, Special District Local Laws
12	12	Code, is amended by adding Chapter 8306 to read as follows:
13	13	CHAPTER 8306. XS RANCH MUNICIPAL UTILITY DISTRICT
14	14	SUBCHAPTER A. GENERAL PROVISIONS
15	15	Sec. 8306.001. DEFINITIONS. In this chapter:
16	16	(1) "Board" means the district's board of directors.
17	17	(2) "Director" means a board member.
18	18	(3) "District" means the XS Ranch Municipal Utility
19	19	District.
20	20	Sec. 8306.002. NATURE OF DISTRICT. The district is a
21	21	municipal utility district created under Section 59, Article XVI,
22	22	Texas Constitution.
23	23	Sec. 8306.003. CONFIRMATION AND DIRECTORS' ELECTION
24	24	REQUIRED. The temporary directors shall hold an election to
25	25	confirm the creation of the district and to elect five permanent
26	26	directors as provided by Section 49.102, Water Code.
27	27	Sec. 8306.004. CONSENT OF MUNICIPALITY REQUIRED. The
28	28	temporary directors may not hold an election under Section 8306.003
29	29	until each municipality in whose corporate limits or
30	30	extraterritorial jurisdiction the district is located has
31	31	consented by ordinance or resolution to the creation of the
32	32	district and to the inclusion of land in the district.
33	33	Sec. 8306.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
34	34	The district is created to serve a public purpose and benefit.
35	35	(b) The district is created to accomplish the purposes of:
36	36	(1) a municipal utility district as provided by
37	37	general law and Section 59, Article XVI, Texas Constitution; and
38	38	(2) Section 52, Article III, Texas Constitution, that
39	39	relate to the construction, acquisition, improvement, operation,
40	40	or maintenance of macadamized, graveled, or paved roads, or
41	41	improvements, including storm drainage, in aid of those roads.
42	42	Sec. 8306.006. INITIAL DISTRICT TERRITORY. (a) The
43	43	district is initially composed of the territory described by
44	44	Section 2 of the Act creating this chapter.
45	45	(b) The boundaries and field notes contained in Section 2 of
46	46	the Act creating this chapter form a closure. A mistake made in the
47	47	field notes or in copying the field notes in the legislative process
48	48	does not affect the district's:
49	49	(1) organization, existence, or validity;
50	50	(2) right to issue any type of bond for the purposes
51	51	for which the district is created or to pay the principal of and
52	52	interest on a bond;
53	53	(3) right to impose a tax; or
54	54	(4) legality or operation.

56	56	SUBCHAPTER B. BOARD OF DIRECTORS
57	57	Sec. 8306.051. GOVERNING BODY; TERMS. (a) The district is
58	58	governed by a board of five elected directors.
59	59	(b) Except as provided by Section 8306.052, directors serve
60	60	staggered four-year terms.
61	61	Sec. 8306.052. TEMPORARY DIRECTORS. (a) The temporary
62	62	board consists of:
63	63	(1) Mark Engels;
64	64	(2) Mark Oldemeyer;
65	65	(3) J. Sulester;
66	66	(4) William Faust; and
67	67	(5) Don Montague.
68	68	(b) Temporary directors serve until the earlier of:
69	69	(1) the date permanent directors are elected under
70	70	Section 8306.003; or
71	71	(2) the fourth anniversary of the effective date of
72	72	the Act creating this chapter.
73	73	(c) If permanent directors have not been elected under
74	74	Section 8306.003 and the terms of the temporary directors have
75	75	expired, successor temporary directors shall be appointed or
76	76	reappointed as provided by Subsection (d) to serve terms that
77	77	expire on the earlier of:
78	78	(1) the date permanent directors are elected under
79	79	Section 8306.003; or
80	80	(2) the fourth anniversary of the date of the
81	81	appointment or reappointment.
82	82	(d) If Subsection (c) applies, the owner or owners of a
83	83	majority of the assessed value of the real property in the district
84	84	may submit a petition to the commission requesting that the
85	85	commission appoint as successor temporary directors the five
86	86	persons named in the petition. The commission shall appoint as
87	87	successor temporary directors the five persons named in the
88	88	petition.

90	90	SUBCHAPTER C. POWERS AND DUTIES
91	91	Sec. 8306.101. GENERAL POWERS AND DUTIES. The district has
92	92	the powers and duties necessary to accomplish the purposes for
93	93	which the district is created.
94	94	Sec. 8306.102. MUNICIPAL UTILITY DISTRICT POWERS AND
95	95	DUTIES. The district has the powers and duties provided by the
96	96	general law of this state, including Chapters 49 and 54, Water Code,
97	97	applicable to municipal utility districts created under Section 59,
98	98	Article XVI, Texas Constitution.
99	99	Sec. 8306.103. AUTHORITY FOR ROAD PROJECTS. Under Section
100	100	52, Article III, Texas Constitution, the district may design,
101	101	acquire, construct, finance, issue bonds for, improve, operate,
102	102	maintain, and convey to this state, a county, or a municipality for
103	103	operation and maintenance macadamized, graveled, or paved roads, or
104	104	improvements, including storm drainage, in aid of those roads.
105	105	Sec. 8306.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
106	106	project must meet all applicable construction standards, zoning and
107	107	subdivision requirements, and regulations of each municipality in
108	108	whose corporate limits or extraterritorial jurisdiction the road
109	109	project is located.
110	110	(b) If a road project is not located in the corporate limits
111	111	or extraterritorial jurisdiction of a municipality, the road
112	112	project must meet all applicable construction standards,
113	113	subdivision requirements, and regulations of each county in which
114	114	the road project is located.
115	115	(c) If the state will maintain and operate the road, the
116	116	Texas Transportation Commission must approve the plans and
117	117	specifications of the road project.
118	118	Sec. 8306.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
119	119	OR RESOLUTION. The district shall comply with all applicable
120	120	requirements of any ordinance or resolution that is adopted under
121	121	Section 54.016 or 54.0165, Water Code, and that consents to the
122	122	creation of the district or to the inclusion of land in the
123	123	district.
124	124	Sec. 8306.106. LIMITATION ON USE OF EMINENT DOMAIN. The
125	125	district may not exercise the power of eminent domain outside the
126	126	district to acquire a site or easement for:
127	127	(1) a road project authorized by Section 8306.103; or
128	128	(2) a recreational facility as defined by Section
129	129	49.462, Water Code.
130	130	Sec. 8306.107. DIVISION OF DISTRICT. (a) The district may
131	131	be divided into two or more new districts only if the district:
132	132	(1) has no outstanding bonded debt; and
133	133	(2) is not imposing ad valorem taxes or assessments.
134	134	(b) Any new district created by the division of the district
135	135	has all the powers and duties of the district, including the power
136	136	to divide in accordance with this section.
137	137	(c) Any new district created by the division of the district
138	138	may not, at the time the new district is created, contain any land
139	139	outside the area described by Section 2 of the Act creating this
140	140	chapter.
141	141	(d) The board, on its own motion or on receipt of a petition
142	142	signed by the owners of a majority of the assessed value of real
143	143	property in the district according to the most recent certified
144	144	appraisal roll for each county in which the district is located, may
145	145	adopt an order dividing the district.
146	146	(e) The board may adopt an order dividing the district
147	147	before or after the date the board holds an election under Section
148	148	8306.003 to confirm the district's creation.
149	149	(f) An order dividing the district shall:
150	150	(1) name each new district;
151	151	(2) include the metes and bounds of each new district;
152	152	(3) appoint temporary directors for each new district;
153	153	and
154	154	(4) provide for the division of assets and liabilities
155	155	between each new district.
156	156	(g) On or before the 30th day after the date of adoption of
157	157	an order dividing the district, the district shall file the order
158	158	with the Texas Commission on Environmental Quality and record the
159	159	order in the real property records of each county in which the
160	160	district is located.
161	161	(h) Any new district created by the division of the district
162	162	shall hold a confirmation and directors' election as required by
163	163	Section 8306.003.
164	164	(i) Any new district created by the division of the district
165	165	must hold an election as required by this chapter to obtain voter
166	166	approval before the district may impose a maintenance tax or issue
167	167	bonds payable wholly or partly from ad valorem taxes.

169	169	SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
170	170	Sec. 8306.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
171	171	district may issue, without an election, bonds and other
172	172	obligations secured by:
173	173	(1) revenue other than ad valorem taxes; or
174	174	(2) contract payments described by Section 8306.153.
175	175	(b) The district must hold an election in the manner
176	176	provided by Chapters 49 and 54, Water Code, to obtain voter approval
177	177	before the district may impose an ad valorem tax or issue bonds
178	178	payable from ad valorem taxes.
179	179	(c) The district may not issue bonds payable from ad valorem
180	180	taxes to finance a road project unless the issuance is approved by a
181	181	vote of a two-thirds majority of the district voters voting at an
182	182	election held for that purpose.
183	183	Sec. 8306.152. OPERATION AND MAINTENANCE TAX. (a) If
184	184	authorized at an election held under Section 8306.151, the district
185	185	may impose an operation and maintenance tax on taxable property in
186	186	the district in accordance with Section 49.107, Water Code.
187	187	(b) The board shall determine the tax rate. The rate may not
188	188	exceed the rate approved at the election.
189	189	Sec. 8306.153. CONTRACT TAXES. (a) In accordance with
190	190	Section 49.108, Water Code, the district may impose a tax other than
191	191	an operation and maintenance tax and use the revenue derived from
192	192	the tax to make payments under a contract after the provisions of
193	193	the contract have been approved by a majority of the district voters
194	194	voting at an election held for that purpose.
195	195	(b) A contract approved by the district voters may contain a
196	196	provision stating that the contract may be modified or amended by
197	197	the board without further voter approval.

199	199	SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
200	200	Sec. 8306.201. AUTHORITY TO ISSUE BONDS AND OTHER
201	201	OBLIGATIONS. The district may issue bonds or other obligations
202	202	payable wholly or partly from ad valorem taxes, impact fees,
203	203	revenue, contract payments, grants, or other district money, or any
204	204	combination of those sources, to pay for any authorized district
205	205	purpose.
206	206	Sec. 8306.202. TAXES FOR BONDS. At the time the district
207	207	issues bonds payable wholly or partly from ad valorem taxes, the
208	208	board shall provide for the annual imposition of a continuing
209	209	direct ad valorem tax, without limit as to rate or amount, while all
210	210	or part of the bonds are outstanding as required and in the manner
211	211	provided by Sections 54.601 and 54.602, Water Code.
212	212	Sec. 8306.203. BONDS FOR ROAD PROJECTS. At the time of
213	213	issuance, the total principal amount of bonds or other obligations
214	214	issued or incurred to finance road projects and payable from ad
215	215	valorem taxes may not exceed one-fourth of the assessed value of the
216	216	real property in the district.
217	217	SECTION 2. The XS Ranch Municipal Utility District
218	218	initially includes all the territory contained in the following
219	219	area:
220	220	A DESCRIPTION OF 9.631 ACRES IN THE ALBERT BLACK SURVEY ABS. NO. 84,
221	221	BASTROP COUNTY, TEXAS, BEING ALL OF A 9.631 ACRE TRACT CONVEYED TO
222	222	XS RANCH FUND VI, L.P. IN A SPECIAL WARRANTY DEED WITH VENDOR'S LIEN
223	223	DATED DECEMBER 19, 2006 AND RECORDED IN DOCUMENT NO. 200619026 OF
224	224	THE OFFICIAL PUBLIC RECORDS OF BASTROP COUNTY, TEXAS; SAID 9.631

1479	1479	under Section 59, Article XVI, Texas Constitution, and Chapter 313,

1481	1481	(b) The governor, one of the required recipients, has
1482	1482	submitted the notice and Act to the Texas Commission on
1483	1483	Environmental Quality.
1484	1484	(c) The Texas Commission on Environmental Quality has filed
1485	1485	its recommendations relating to this Act with the governor, the
1486	1486	lieutenant governor, and the speaker of the house of
1487	1487	representatives within the required time.
1488	1488	(d) All requirements of the constitution and laws of this
1489	1489	state and the rules and procedures of the legislature with respect
1490	1490	to the notice, introduction, and passage of this Act are fulfilled
1491	1491	and accomplished.
1492	1492	SECTION 4. This Act takes effect immediately if it receives
1493	1493	a vote of two-thirds of all the members elected to each house, as
1494	1494	provided by Section 39, Article III, Texas Constitution. If this
1495	1495	Act does not receive the vote necessary for immediate effect, this
1496	1496	Act takes effect September 1, 2009.
