55 AN ACT
66 relating to authorization for the Department of Aging and
77 Disability Services to conduct a desk review instead of an
88 inspection when issuing a license after a change in ownership of
99 certain facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 142.009, Health and Safety Code, is
1212 amended by amending Subsection (j) and adding Subsection (j-1) to
1313 read as follows:
1414 (j) Except as provided by Subsections (j-1), (h), and (l),
1515 an on-site survey must be conducted within 18 months after a survey
1616 for an initial license. After that time, an on-site survey must be
1717 conducted at least every 36 months.
1818 (j-1) The department, in accordance with department rules,
1919 may conduct a desk review instead of the initial survey required by
2020 Subsection (j) if the license application is submitted due to a
2121 change in ownership of an agency under this chapter. The executive
2222 commissioner of the Health and Human Services Commission by rule
2323 shall develop criteria for determining when the department may
2424 conduct a desk review instead of an on-site survey.
2525 SECTION 2. Section 247.023, Health and Safety Code, is
2626 amended by adding Subsection (a-1) to read as follows:
2727 (a-1) The department, in accordance with department rules,
2828 may conduct a desk review instead of the inspection and
2929 investigation required by Subsection (a) if the license application
3030 is submitted due to a change in ownership of a facility under this
3131 chapter. The executive commissioner of the Health and Human
3232 Services Commission by rule shall develop criteria for determining
3333 when the department may conduct a desk review instead of an
3434 inspection and investigation.
3535 SECTION 3. Section 252.033, Health and Safety Code, is
3636 amended by adding Subsection (a-1) to read as follows:
3737 (a-1) The department, in accordance with department rules,
3838 may conduct a desk review instead of the on-site inspection and
3939 investigation under Subsection (a) if the license application is
4040 submitted due to a change in ownership of a facility under this
4141 chapter. The executive commissioner of the Health and Human
4242 Services Commission by rule shall develop criteria for determining
4343 when the department may conduct a desk review instead of an on-site
4444 inspection and investigation.
4545 SECTION 4. Section 103.006, Human Resources Code, is
4646 amended by adding Subsection (a-1) to read as follows:
4747 (a-1) The department, in accordance with department rules,
4848 may conduct a desk review instead of the on-site inspection under
4949 Subsection (a) if the license application is submitted due to a
5050 change in ownership of the facility under this chapter. The
5151 executive commissioner of the Health and Human Services Commission
5252 by rule shall develop criteria for determining when the department
5353 may conduct a desk review instead of an on-site inspection.
5454 SECTION 5. (a) Not later than April 1, 2010, the executive
5555 commissioner of the Health and Human Services Commission shall
5656 adopt the rules required under Subsection (j-1), Section 142.009,
5757 Subsection (a-1), Section 247.023, and Subsection (a-1), Section
5858 252.033, Health and Safety Code, and Subsection (a-1), Section
5959 103.006, Human Resources Code, as added by this Act.
6060 (b) Notwithstanding Subsection (j-1), Section 142.009,
6161 Subsection (a-1), Section 247.023, and Subsection (a-1), Section
6262 252.033, Health and Safety Code, as added by this Act, and
6363 Subsection (a-1), Section 103.006, Human Resources Code, as added
6464 by this Act, the Department of Aging and Disability Services may not
6565 conduct a desk review instead of a survey, inspection, or
6666 investigation for a license application submitted due to a change
6767 in ownership of an agency or facility under those sections until May
6868 1, 2010.
6969 SECTION 6. This Act takes effect September 1, 2009.
