7 | 7 | | relating to resident tuition rates at public institutions of higher |
---|
8 | 8 | | education for certain veterans and their dependents. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 54.058, Education Code, is amended by |
---|
11 | 11 | | adding Subsections (k) and (l) to read as follows: |
---|
12 | 12 | | (k) The following persons are entitled to pay tuition and |
---|
13 | 13 | | fees at an institution of higher education at the rates provided for |
---|
14 | 14 | | Texas residents without regard to the length of time the person has |
---|
15 | 15 | | resided in this state so long as the person maintains a domicile in |
---|
16 | 16 | | this state during each semester or other term in which the person is |
---|
17 | 17 | | enrolled in the institution: |
---|
18 | 18 | | (1) a person who: |
---|
19 | 19 | | (A) is eligible for benefits under the federal |
---|
20 | 20 | | Post-9/11 Veterans Educational Assistance Act of 2008 (Pub. L. No. |
---|
21 | 21 | | 110-252) or any other federal law authorizing educational benefits |
---|
22 | 22 | | for veterans; and |
---|
23 | 23 | | (B) during enrollment participates in: |
---|
24 | 24 | | (i) a community service program approved |
---|
25 | 25 | | under rules of the Texas Higher Education Coordinating Board; or |
---|
26 | 26 | | (ii) an internship or cooperative education |
---|
27 | 27 | | program administered by the institution; and |
---|
28 | 28 | | (2) a person who: |
---|
29 | 29 | | (A) is the spouse or a dependent child of a person |
---|
30 | 30 | | described by Subdivision (1)(A); and |
---|
31 | 31 | | (B) during enrollment participates in: |
---|
32 | 32 | | (i) a community service program approved |
---|
33 | 33 | | under rules of the Texas Higher Education Coordinating Board; or |
---|
34 | 34 | | (ii) an internship or cooperative education |
---|
35 | 35 | | program administered by the institution. |
---|
36 | 36 | | (l) The Texas Higher Education Coordinating Board shall |
---|
37 | 37 | | adopt rules for the administration of Subsection (k), including |
---|
38 | 38 | | rules for the approval of community service programs for purposes |
---|
39 | 39 | | of that subsection. |
---|
40 | 40 | | SECTION 2. (a) Section 54.058(k), Education Code, as added |
---|
41 | 41 | | by this Act, applies beginning with tuition and other fees charged |
---|
42 | 42 | | for the first term or semester that begins after the effective date |
---|
43 | 43 | | of this Act, but not earlier than the 2009 fall semester. Tuition |
---|
44 | 44 | | and other fees charged for an academic period before that term or |
---|
45 | 45 | | semester are covered by the law in effect immediately before the |
---|
46 | 46 | | effective date of this Act, and the former law is continued in |
---|
47 | 47 | | effect for that purpose. |
---|
48 | 48 | | (b) The Texas Higher Education Coordinating Board shall |
---|
49 | 49 | | adopt rules as provided by Section 54.058(l), Education Code, as |
---|
50 | 50 | | added by this Act, as soon as practicable after this Act takes |
---|
51 | 51 | | effect. For that purpose, the coordinating board may adopt the |
---|
52 | 52 | | initial rules in the manner provided by law for emergency rules. |
---|
53 | 53 | | SECTION 3. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2009. |
