55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to resident tuition rates at public institutions of higher
88 education for certain veterans and their dependents.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 54.058, Education Code, is amended by
1111 adding Subsections (k) and (l) to read as follows:
1212 (k) The following persons are entitled to pay tuition and
1313 fees at an institution of higher education at the rates provided for
1414 Texas residents without regard to the length of time the person has
1515 resided in this state so long as the person maintains a domicile in
1616 this state during each semester or other term in which the person is
1717 enrolled in the institution:
1818 (1) a person who:
1919 (A) is eligible for benefits under the federal
2020 Post-9/11 Veterans Educational Assistance Act of 2008 (Pub. L. No.
2121 110-252) or any other federal law authorizing educational benefits
2222 for veterans; and
2323 (B) during enrollment participates in:
2424 (i) a community service program approved
2525 under rules of the Texas Higher Education Coordinating Board; or
2626 (ii) an internship or cooperative education
2727 program administered by the institution; and
2828 (2) a person who:
2929 (A) is the spouse or a dependent child of a person
3030 described by Subdivision (1)(A); and
3131 (B) during enrollment participates in:
3232 (i) a community service program approved
3333 under rules of the Texas Higher Education Coordinating Board; or
3434 (ii) an internship or cooperative education
3535 program administered by the institution.
3636 (l) The Texas Higher Education Coordinating Board shall
3737 adopt rules for the administration of Subsection (k), including
3838 rules for the approval of community service programs for purposes
3939 of that subsection.
4040 SECTION 2. (a) Section 54.058(k), Education Code, as added
4141 by this Act, applies beginning with tuition and other fees charged
4242 for the first term or semester that begins after the effective date
4343 of this Act, but not earlier than the 2009 fall semester. Tuition
4444 and other fees charged for an academic period before that term or
4545 semester are covered by the law in effect immediately before the
4646 effective date of this Act, and the former law is continued in
4747 effect for that purpose.
4848 (b) The Texas Higher Education Coordinating Board shall
4949 adopt rules as provided by Section 54.058(l), Education Code, as
5050 added by this Act, as soon as practicable after this Act takes
5151 effect. For that purpose, the coordinating board may adopt the
5252 initial rules in the manner provided by law for emergency rules.
5353 SECTION 3. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2009.
