| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 41.0051, Election Code, is repealed. | |
| 11 | 11 | SECTION 2. (a) Not later than December 31, 2009, each of | |
| 12 | 12 | the following shall choose a uniform election date for its general | |
| 13 | 13 | election for officers in 2011 and subsequent years: | |
| 14 | 14 | (1) the governing body of a city that held its general | |
| 15 | 15 | election for officers in 2007 on a date authorized by Section | |
| 16 | 16 | 41.0051, Election Code; and | |
| 17 | 17 | (2) an independent school district located wholly or | |
| 18 | 18 | partly in a city described by Subdivision (1) of this subsection. | |
| 19 | 19 | (b) The governing body of a political subdivision required | |
| 20 | 20 | to change its election date under this section shall adjust the | |
| 21 | 21 | terms of office to conform to the new election date. | |
| 22 | 22 | SECTION 3. All elections held under Section 41.0051, | |
| 23 | 23 | Election Code, before the effective date of this Act are validated, | |
| 24 | 24 | ratified, and confirmed in all respects. | |
| 25 | 25 | SECTION 4. This Act takes effect September 1, 2009. |
