55 AN ACT
66 relating to authorizing the issuance of revenue bonds or other
77 obligations to fund capital projects at public institutions of
88 higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1111 amended by adding Sections 55.1771, 55.1772, 55.1773, 55.1774,
1212 55.1775, 55.1776, 55.1777, 55.1778, 55.1779, 55.1780, and 55.1781
1313 to read as follows:
1414 Sec. 55.1771. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
1515 BONDS. (a) In addition to the other authority granted by this
1616 subchapter, the board of regents of The Texas A&M University System
1717 may acquire, purchase, construct, improve, renovate, enlarge, or
1818 equip facilities, including roads and related infrastructure, for
1919 projects to be financed through the issuance of bonds in accordance
2020 with this subchapter and in accordance with a systemwide revenue
2121 financing program adopted by the board for the following
2222 institutions and facilities not to exceed the following aggregate
2323 principal amounts for the projects specified as follows:
2424 (1) Tarleton State University:
2525 (A) $53,000,000 for the renovation and
2626 rehabilitation of the O.A. Grant Building, Joe Autry Agricultural
2727 Building, and the Engineering Technology Building;
2828 (B) $26,000,000 for a Student Success Center and
2929 classroom building;
3030 (C) $58,000,000 for a Special Events Center; and
3131 (D) $29,000,000 for an Environmental and
3232 Agribusiness Research Building.
3333 (2) Texas A&M University-Commerce:
3434 (A) $23,250,000 for renovation of the University
3535 Library; and
3636 (B) $11,250,000 for renovation of the Ferguson
3737 Auditorium and Hall of Languages Building;
3838 (3) Texas A&M University-Corpus Christi:
3939 (A) $75 million for a life sciences building;
4040 (B) $50 million for a fine arts center; and
4141 (C) $31,000,000 for a Learning Resource Center
4242 (4) Texas A&M University-Kingsville:
4343 (A) $70 million for a performing and visual arts
4444 educational complex; and
4545 (B) $65 million for a natural
4646 resources/agriculture academic complex;
4747 (5) Texas A&M University-Texarkana, $46 million for a

7070 (10) Texas A&M University at Galveston, $46 million
7171 for facilities renewal; and
7272 (11) Texas A&M International University:
7373 (A) $32,500,000 for an academic classroom
7474 building; and
7575 (B) $12 million for library expansion and a
7676 support services building.
7777 (12) Texas A&M System Centers:
7878 (A) Texas A&M-Central Texas: $50,000,000 for a
7979 new Classroom/Lab/Office Building
8080 (B) Texas A&M-San Antonio: $60,000,000 for a new
8181 Classroom/Lab/Office Building
8282 (b) The board may pledge irrevocably to the payment of bonds
8383 authorized by this section all or any part of the revenue funds of
8484 an institution, branch, or entity of The Texas A&M University
8585 System, including student tuition charges. The amount of a pledge
8686 made under this subsection may not be reduced or abrogated while the
8787 bonds for which the pledge is made, or bonds issued to refund those
8888 bonds, are outstanding.
8989 (c) If sufficient funds are not available to the board to
9090 meet its obligations under this section, the board may transfer
9191 funds among institutions, branches, and entities of The Texas A&M
9292 University System to ensure the most equitable and efficient
9393 allocation of available resources for each institution, branch, or
9494 entity to carry out its duties and purposes.
9595 Sec. 55.1772. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
9696 BONDS. (a) In addition to the other authority granted by this
9797 subchapter, the board of regents of The University of Texas System
9898 may acquire, purchase, construct, improve, renovate, enlarge, or
9999 equip facilities, including roads and related infrastructure, for
100100 projects to be financed through the issuance of bonds in accordance
101101 with this subchapter and in accordance with a systemwide revenue
102102 financing program adopted by the board for the following
103103 institutions not to exceed the following aggregate principal
104104 amounts for the projects specified as follows:
105105 (1) The University of Texas at Arlington:
106106 (A) $31,000,000 for an Engineering Research
107107 Building; and
108108 (B) $60,000,000 for a Nanofab building;
109109 (2) The University of Texas at Austin:

186186 (c) If sufficient funds are not available to the board to
187187 meet its obligations under this section, the board may transfer
188188 funds among institutions, branches, and entities of The University
189189 of Texas System to ensure the most equitable and efficient
190190 allocation of available resources for each institution, branch, or
191191 entity to carry out its duties and purposes.
192192 Sec. 55.1773. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
193193 BONDS. (a) In addition to the other authority granted by this
194194 subchapter, the board of regents of the University of Houston
195195 System may acquire, purchase, construct, improve, renovate,
196196 enlarge, or equip facilities, including roads and related
197197 infrastructure, for the following institutions, to be financed
198198 through the issuance of bonds in accordance with this subchapter
199199 and in accordance with a systemwide revenue financing program
200200 adopted by the board, in aggregate principal amounts not to exceed
201201 the following:
202202 (1) the University of Houston:
203203 (A) $83,000,000 for a energy and wind research
204204 building;
205205 (B) $75,000,000 for a bio-life sciences research
206206 building; and
207207 (C) $27,000,000 for a multi-cultural studies and
208208 classroom complex;
209209 (2) the University of Houston--Clear Lake,
210210 $68,600,000 for an academic enrichment and research facility;
211211 (3) the University of Houston--Downtown, $51,429,000
212212 for a science and technology building; and
213213 (4) the University of Houston-Victoria, $30,500,000
214214 for a health and kinesiology education building.
215215 (b) The board may pledge irrevocably to the payment of bonds
216216 authorized by this section all or any part of the revenue funds of
217217 an institution, branch, or entity of the University of Houston
218218 System, including student tuition charges. The amount of a pledge
219219 made under this subsection may not be reduced or abrogated while the
220220 bonds for which the pledge is made, or bonds issued to refund those
221221 bonds, are outstanding.
222222 (c) If sufficient funds are not available to the board to
223223 meet its obligations under this section, the board may transfer
224224 funds among institutions, branches, and entities of the University
225225 of Houston System to ensure the most equitable and efficient
226226 allocation of available resources for each institution, branch, or
227227 entity to carry out its duties and purposes.
228228 Sec. 55.1774. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
229229 BONDS. (a) In addition to the other authority granted by this
230230 subchapter, the board of regents of the Texas State University
231231 System may acquire, purchase, construct, improve, renovate,
232232 enlarge, or equip facilities, including roads and related
233233 infrastructure, for projects to be financed through the issuance of
234234 bonds in accordance with this subchapter and in accordance with a
235235 systemwide revenue financing program adopted by the board for the
236236 following institutions not to exceed the following aggregate
237237 principal amounts for the projects specified as follows:
238238 (1) Lamar University:
239239 (A) $25,000,000 for a new science building;
240240 (B) $15,000,000 for a facilities management
241241 complex;
242242 (C) $36,000,000 for renovation of academic
243243 buildings;
244244 (D) $15,000,000 for a new administration
245245 services building;
246246 (E) $5,000,000 for a new security and computing
247247 center;
248248 (F) $10,000,000 for Addition II to the Cherry
249249 Engineering Building; and
250250 (G) $2,000,000 for the land acquisition;
251251 (2) Lamar State College-Orange:
252252 (A) $3,600,000 for a workforce training center;
253253 and
254254 (B) $6,000,000 for a multi-purpose educational
255255 building;
256256 (3) Lamar State College-Port Arthur:
257257 (A) $1,100,000 for an addition to the allied

286286 (B) $1,500,000 for a student success center.
287287 (b) The board may pledge irrevocably to the payment of bonds
288288 authorized by this section all or any part of the revenue funds of
289289 an institution, branch, or entity of the Texas State University
290290 System, including student tuition charges. The amount of a pledge
291291 made under this subsection may not be reduced or abrogated while the
292292 bonds for which the pledge is made, or bonds issued to refund those
293293 bonds, are outstanding.
294294 (c) If sufficient funds are not available to the board to
295295 meet its obligations under this section, the board may transfer
296296 funds among institutions, branches, and entities of the Texas State
297297 University System to ensure the most equitable and efficient
298298 allocation of available resources for each institution, branch, or
299299 entity to carry out its duties and purposes.
300300 Sec. 55.1775. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
301301 BONDS. (a) In addition to the other authority granted by this
302302 subchapter, the board of regents of the University of North Texas
303303 System may acquire, purchase, construct, improve, renovate,
304304 enlarge, or equip facilities, including roads and related
305305 infrastructure, for projects to be financed through the issuance of
306306 bonds in accordance with this subchapter and in accordance with a
307307 systemwide revenue financing program adopted by the board for the
308308 following institutions and facilities not to exceed the following
309309 aggregate principal amounts for the projects specified as follows:
310310 (1) the University of North Texas System, $40,000,000
311311 for a College of Law;
312312 (2) the University of North Texas, $63,000,000 for a
313313 College of Visual Arts and Design building; and
314314 (3) the University of North Texas Dallas Campus,
315315 $18,500,000 for a second building.
316316 (4) the University of North Texas Health Sciences
317317 Center. $90,000,000 for a new Research Building
318318 (b) The board may pledge irrevocably to the payment of bonds
319319 authorized by this section all or any part of the revenue funds of
320320 an institution, branch, or entity of the University of North Texas
321321 System, including student tuition charges. The amount of a pledge
322322 made under this subsection may not be reduced or abrogated while the
323323 bonds for which the pledge is made, or bonds issued to refund those
324324 bonds, are outstanding.
325325 (c) If sufficient funds are not available to the board to
326326 meet its obligations under this section, the board may transfer
327327 funds among institutions, branches, and entities of the University
328328 of North Texas System to ensure the most equitable and efficient
329329 allocation of available resources for each institution, branch, or
330330 entity to carry out its duties and purposes.
331331 (d) Notwithstanding Subsection (a), the University of North
332332 Texas System may not issue bonds under this section for facilities
333333 at the University of North Texas Dallas Campus until the Texas
334334 Higher Education Coordinating Board certifies that enrollment at
335335 the University of North Texas Dallas Campus has reached an
336336 enrollment equivalent of 1,500 full-time students for one semester.
337337 If that enrollment is not reached by January 1, 2010, the system's
338338 authority to issue bonds for the University of North Texas Dallas
339339 Campus under this section expires on that date.
340340 Sec. 55.1776. TEXAS WOMAN'S UNIVERSITY. (a) In addition to
341341 the other authority granted by this subchapter, the board of
342342 regents of Texas Woman's University may acquire, purchase,
343343 construct, improve, renovate, enlarge, or equip facilities,
344344 including roads and related infrastructure, for projects to be
345345 financed through the issuance of bonds in accordance with this
346346 subchapter and in accordance with a systemwide revenue financing
347347 program adopted by the board for the following institutions and
348348 facilities not to exceed the following aggregate principal amounts
349349 for the projects specified as follows:
350350 (1) $26,000,000 for a graduate research building;
351351 (2) $17,500,000 for the renovation of the old main
352352 building;
353353 (3) $9,500,000 for a new academic support and
354354 administrative support building; and
355355 (4) $4,800,000 for infrastructure repair and upgrade.
356356 (b) The board may pledge irrevocably to the payment of bonds
357357 authorized by this section all or any part of the revenue funds of
358358 Texas Woman's University, including student tuition charges. The
359359 amount of a pledge made under this subsection may not be reduced or
360360 abrogated while the bonds for which the pledge is made, or bonds
361361 issued to refund those bonds, are outstanding.
362362 Sec. 55.1777. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
363363 BONDS. (a) In addition to the other authority granted by this
364364 subchapter, the board of regents of Midwestern State University may
365365 acquire, purchase, construct, improve, renovate, enlarge, or equip
366366 facilities, including roads and related infrastructure, for
367367 projects at Midwestern State University, to be financed through the
368368 issuance of bonds in accordance with this subchapter not to exceed
369369 the following aggregate principal amounts for the projects
370370 specified as follows:
371371 (1) $6,420,000 for Phase II of the renovation of the D.
372372 L. Ligon Building; and
373373 (2) $40,000,000 for the reconstruction of the Moffett
374374 Library.
375375 (b) The board may pledge irrevocably to the payment of bonds
376376 authorized by this section all or any part of the revenue funds of
377377 Midwestern State University, including student tuition charges.
378378 The amount of a pledge made under this subsection may not be reduced
379379 or abrogated while the bonds for which the pledge is made, or bonds
380380 issued to refund those bonds, are outstanding.
381381 Sec. 55.1778. STEPHEN F. AUSTIN STATE UNIVERSITY. (a) In
382382 addition to the other authority granted by this subchapter, the
383383 board of regents of Stephen F. Austin State University may acquire,
384384 purchase, construct, improve, renovate, enlarge, or equip
385385 facilities, including roads and related infrastructure, for a
386386 molecular sciences building at Stephen F. Austin State University,
387387 to be financed through the issuance of bonds in accordance with this
388388 subchapter not to exceed the aggregate principal amount of
389389 $46,000,000.
390390 (b) The board may pledge irrevocably to the payment of bonds
391391 authorized by this section all or any part of the revenue funds of
392392 Stephen F. Austin State University, including student tuition
393393 charges. The amount of a pledge made under this subsection may not
394394 be reduced or abrogated while the bonds for which the pledge is
395395 made, or bonds issued to refund those bonds, are outstanding.
396396 Sec. 55.1779. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
397397 BONDS. (a) In addition to the other authority granted by this
398398 subchapter, the board of regents of the Texas Tech University
399399 System may acquire, purchase, construct, improve, renovate,
400400 enlarge, or equip facilities, including roads and related
401401 infrastructure, for projects to be financed through the issuance of
402402 bonds in accordance with this subchapter and in accordance with a
403403 systemwide revenue financing program adopted by the board not to
404404 exceed the following aggregate principal amounts for the projects
405405 specified as follows:
406406 (1) Texas Tech University Health Sciences Center:
407407 (A) $72,000,000 for Lubbock
408408 Education/Research/Technology and renovation;
409409 (B) $58,500,000 for the EL Paso Medical Science
410410 Building II;
411411 (C) $27,000,000 for the El Paso Clinical Sciences
412412 Building;
413413 (D) $12,600,000 for the Permian Basin medical
414414 education facility; and
415415 (E) $14,850,000 for the Panhandle
416416 clinical/hospital simulation center;
417417 (2) Texas Tech University:
418418 (A) $95,000,000 for the expansion and renovation
419419 of the College of Engineering;
420420 (B) $42,500,000 for a Plant and Soil Sciences
421421 Building; and
422422 (C) $45,000,000 for a performing arts center; and
423423 (3) Angelo State University:
424424 (A) $40,000,000 for the College of Nursing and
425425 Allied Health;
426426 (B) $35,000,000 for campus modernization and
427427 expansion; and
428428 (C) $42,325,000 for a Performing Arts Center.
429429 (b) The board may pledge irrevocably to the payment of bonds
430430 authorized by this section all or any part of the revenue funds of
431431 an institution, branch, or entity of the Texas Tech University
432432 System, including student tuition charges. The amount of a pledge
433433 made under this subsection may not be reduced or abrogated while the
434434 bonds for which the pledge is made, or bonds issued to refund those
435435 bonds, are outstanding.
436436 (c) If sufficient funds are not available to the board to
437437 meet its obligations under this section, the board may transfer
438438 funds among institutions, branches, and entities of the Texas Tech
439439 University System to ensure the most equitable and efficient
440440 allocation of available resources for each institution, branch, or
441441 entity to carry out its duties and purposes.
442442 Sec. 55.1780. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL BONDS.
443443 (a) In addition to the other authority granted by this subchapter,
444444 the board of regents of Texas Southern University may acquire,
445445 purchase, construct, improve, renovate, enlarge, or equip
446446 facilities, including roads and related infrastructure, for
447447 projects at Texas Southern University, to be financed through the
448448 issuance of bonds in accordance with this subchapter not to exceed
449449 the following aggregate principal amounts for the projects
450450 specified as follows:
451451 (1) $46,000,000 for renovation of the Robert J. Terry
452452 Library;
453453 (2) $9,450,000 for a Spearman technology building;
454454 (3) $4,500,000 for Multi-purpose Academic Center;
455455 (4) $30,000,000 for deferred maintenance;
456456 (5) $5,000,000 for asbestos abatement and removal;
457457 (6) $10,000,000 for campus
458458 infrastructure/beautification; and
459459 (7) $4,000,000 for land acquisition/Multi-Purpose
460460 Academic Center.
461461 (b) The board may pledge irrevocably to the payment of bonds
462462 authorized by this section all or any part of the revenue funds of
463463 Texas Southern University, including student tuition charges. The
464464 amount of a pledge made under this subsection may not be reduced or
465465 abrogated while the bonds for which the pledge is made, or bonds
466466 issued to refund those bonds, are outstanding.
467467 Sec. 55.1781. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a) In
468468 addition to the other authority granted by this subchapter, the
469469 board of regents of the Texas State Technical College System may
470470 acquire, purchase, construct, improve, renovate, enlarge, or equip
471471 property, buildings, structures, facilities, roads, or related
472472 infrastructure, for projects to be financed through the issuance of
473473 bonds in accordance with this subchapter not to exceed the
474474 following aggregate principal amounts for the projects specified as
475475 follows:
476476 (1) Texas State Technical College-Harlingen,
477477 $8,000,000 to construct an academic building;
478478 (2) Texas State Technical College-Brownwood,
479479 $3,000,000 to renovate an academic building;
480480 (3) Texas State Technical College-Marshall,
481481 $2,500,000 for a diesel equipment technology building; and
482482 (4)Texas State Technical College-Waco:
483483 (A) $10,000,000 for a learning services center;
484484 and
485485 (B) $5,000,000 for Phase II of the East
486486 Williamson County Education Center.
487487 (b) The board may pledge irrevocably to the payment of those
488488 bonds all or any part of the revenue funds of an institution,
489489 branch, or entity of the Texas State Technical College System,
490490 including student tuition charges. The amount of a pledge made
491491 under this subsection may not be reduced or abrogated while the
492492 bonds for which the pledge is made, or bonds issued to refund those
493493 bonds, are outstanding.
494494 (c) If sufficient funds are not available to the board to
495495 meet its obligations under this section, the board may transfer
496496 funds among institutions, branches, and entities of the Texas State
497497 Technical College System to ensure the most equitable and efficient
498498 allocation of available resources for each institution, branch, or
499499 entity to carry out its duties and purposes.
500500 SECTION 2. Section 61.0572(e), Education Code, is amended
501501 to read as follows:
502502 (e) Approval of the board is not required to acquire real
503503 property that is financed by bonds issued under Section 55.17(e)(3)
504504 or (4), 55.1713-55.1718, 55.1721-55.1728, 55.1735(a)(1), 55.174,

507507 property to be financed by bonds issued under those sections to
508508 determine whether the property meets the standards adopted by the
509509 board for cost, efficiency, and space use. If the property does not
510510 meet those standards, the board shall notify the governor, the
511511 lieutenant governor, the speaker of the house of representatives,
512512 and the Legislative Budget Board.
513513 SECTION 3. Section 61.058(b), Education Code, is amended to
514514 read as follows:
515515 (b) This section does not apply to construction, repair, or
516516 rehabilitation financed by bonds issued under Section 55.17(e)(3)
517517 or (4), 55.1713-55.1718, 55.1721-55.1728, 55.174, 55.1742,
518518 55.1743, 55.1744 [or] 55.1751-55.17.592 , or 55.1771-55.1781,
519519 except that the board shall review all construction, repair, or
520520 rehabilitation to be financed by bonds issued under those sections
521521 to determine whether the construction, rehabilitation, or repair
522522 meets the standards adopted by board rule for cost, efficiency, and
523523 space use. If the construction, rehabilitation, or repair does not
524524 meet those standards, the board shall notify the governor, the
525525 lieutenant governor, the speaker of the house of representatives,
526526 and the Legislative Budget Board.
527527 SECTION 4. This Act does not affect any authority or
528528 restriction regarding the activities that a public institution of
529529 higher education may conduct in connection with a facility financed
530530 by bonds authorized by this Act.
531531 SECTION 5. This Act takes effect immediately if it receives
532532 a vote of two-thirds of all the members elected to each house, as
533533 provided by Section 39, Article III, Texas Constitution. If this
534534 Act does not receive the vote necessary for immediate effect, this
535535 Act takes effect on the 91st day after the last day of the
536536 legislative session.
