6	6	relating to authorizing the issuance of revenue bonds or other
7	7	obligations to fund capital projects at public institutions of
8	8	higher education.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter B, Chapter 55, Education Code, is
11	11	amended by adding Sections 55.1771, 55.1772, 55.1773, 55.1774,
12	12	55.1775, 55.1776, 55.1777, 55.1778, 55.1779, 55.1780, and 55.1781
13	13	to read as follows:
14	14	Sec. 55.1771. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
15	15	BONDS. (a) In addition to the other authority granted by this
16	16	subchapter, the board of regents of The Texas A&M University System
17	17	may acquire, purchase, construct, improve, renovate, enlarge, or
18	18	equip facilities, including roads and related infrastructure, for
19	19	projects to be financed through the issuance of bonds in accordance
20	20	with this subchapter and in accordance with a systemwide revenue
21	21	financing program adopted by the board for the following
22	22	institutions and facilities not to exceed the following aggregate
23	23	principal amounts for the projects specified as follows:
24	24	(1) Tarleton State University:
25	25	(A) $53,000,000 for the renovation and
26	26	rehabilitation of the O.A. Grant Building, Joe Autry Agricultural
27	27	Building, and the Engineering Technology Building;
28	28	(B) $26,000,000 for a Student Success Center and
29	29	classroom building;
30	30	(C) $58,000,000 for a Special Events Center; and
31	31	(D) $29,000,000 for an Environmental and
32	32	Agribusiness Research Building.
33	33	(2) Texas A&M University-Commerce:
34	34	(A) $23,250,000 for renovation of the University
35	35	Library; and
36	36	(B) $11,250,000 for renovation of the Ferguson
37	37	Auditorium and Hall of Languages Building;
38	38	(3) Texas A&M University-Corpus Christi:
39	39	(A) $75 million for a life sciences building;
40	40	(B) $50 million for a fine arts center; and
41	41	(C) $31,000,000 for a Learning Resource Center
42	42	(4) Texas A&M University-Kingsville:
43	43	(A) $70 million for a performing and visual arts

78	78	(A) Texas A&M-Central Texas: $50,000,000 for a
79	79	new Classroom/Lab/Office Building

82	82	(b) The board may pledge irrevocably to the payment of bonds
83	83	authorized by this section all or any part of the revenue funds of
84	84	an institution, branch, or entity of The Texas A&M University
85	85	System, including student tuition charges. The amount of a pledge
86	86	made under this subsection may not be reduced or abrogated while the
87	87	bonds for which the pledge is made, or bonds issued to refund those
88	88	bonds, are outstanding.
89	89	(c) If sufficient funds are not available to the board to
90	90	meet its obligations under this section, the board may transfer
91	91	funds among institutions, branches, and entities of The Texas A&M
92	92	University System to ensure the most equitable and efficient
93	93	allocation of available resources for each institution, branch, or
94	94	entity to carry out its duties and purposes.
95	95	Sec. 55.1772. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
96	96	BONDS. (a) In addition to the other authority granted by this
97	97	subchapter, the board of regents of The University of Texas System
98	98	may acquire, purchase, construct, improve, renovate, enlarge, or
99	99	equip facilities, including roads and related infrastructure, for
100	100	projects to be financed through the issuance of bonds in accordance
101	101	with this subchapter and in accordance with a systemwide revenue
102	102	financing program adopted by the board for the following
103	103	institutions not to exceed the following aggregate principal
104	104	amounts for the projects specified as follows:
105	105	(1) The University of Texas at Arlington:
106	106	(A) $31,000,000 for an Engineering Research
107	107	Building; and
108	108	(B) $60,000,000 for a Nanofab building;

193	193	BONDS. (a) In addition to the other authority granted by this
194	194	subchapter, the board of regents of the University of Houston
195	195	System may acquire, purchase, construct, improve, renovate,
196	196	enlarge, or equip facilities, including roads and related
197	197	infrastructure, for the following institutions, to be financed
198	198	through the issuance of bonds in accordance with this subchapter
199	199	and in accordance with a systemwide revenue financing program
200	200	adopted by the board, in aggregate principal amounts not to exceed
201	201	the following:
202	202	(1) the University of Houston:
203	203	(A) $83,000,000 for a energy and wind research
204	204	building;
205	205	(B) $75,000,000 for a bio-life sciences research
206	206	building; and
207	207	(C) $27,000,000 for a multi-cultural studies and
208	208	classroom complex;
209	209	(2) the University of Houston--Clear Lake,
210	210	$68,600,000 for an academic enrichment and research facility;
211	211	(3) the University of Houston--Downtown, $51,429,000
212	212	for a science and technology building; and
213	213	(4) the University of Houston-Victoria, $30,500,000
214	214	for a health and kinesiology education building.
215	215	(b) The board may pledge irrevocably to the payment of bonds
216	216	authorized by this section all or any part of the revenue funds of
217	217	an institution, branch, or entity of the University of Houston
218	218	System, including student tuition charges. The amount of a pledge
219	219	made under this subsection may not be reduced or abrogated while the
220	220	bonds for which the pledge is made, or bonds issued to refund those
221	221	bonds, are outstanding.
222	222	(c) If sufficient funds are not available to the board to
223	223	meet its obligations under this section, the board may transfer
224	224	funds among institutions, branches, and entities of the University
225	225	of Houston System to ensure the most equitable and efficient
226	226	allocation of available resources for each institution, branch, or
227	227	entity to carry out its duties and purposes.
228	228	Sec. 55.1774. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
229	229	BONDS. (a) In addition to the other authority granted by this
230	230	subchapter, the board of regents of the Texas State University
231	231	System may acquire, purchase, construct, improve, renovate,
232	232	enlarge, or equip facilities, including roads and related
233	233	infrastructure, for projects to be financed through the issuance of
234	234	bonds in accordance with this subchapter and in accordance with a
235	235	systemwide revenue financing program adopted by the board for the
236	236	following institutions not to exceed the following aggregate
237	237	principal amounts for the projects specified as follows:
238	238	(1) Lamar University:
239	239	(A) $25,000,000 for a new science building;
240	240	(B) $15,000,000 for a facilities management
241	241	complex;
242	242	(C) $36,000,000 for renovation of academic
243	243	buildings;
244	244	(D) $15,000,000 for a new administration
245	245	services building;
246	246	(E) $5,000,000 for a new security and computing
247	247	center;
248	248	(F) $10,000,000 for Addition II to the Cherry
249	249	Engineering Building; and

288	288	authorized by this section all or any part of the revenue funds of
289	289	an institution, branch, or entity of the Texas State University
290	290	System, including student tuition charges. The amount of a pledge
291	291	made under this subsection may not be reduced or abrogated while the
292	292	bonds for which the pledge is made, or bonds issued to refund those
293	293	bonds, are outstanding.
294	294	(c) If sufficient funds are not available to the board to
295	295	meet its obligations under this section, the board may transfer
296	296	funds among institutions, branches, and entities of the Texas State
297	297	University System to ensure the most equitable and efficient
298	298	allocation of available resources for each institution, branch, or
299	299	entity to carry out its duties and purposes.
300	300	Sec. 55.1775. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
301	301	BONDS. (a) In addition to the other authority granted by this
302	302	subchapter, the board of regents of the University of North Texas
303	303	System may acquire, purchase, construct, improve, renovate,
304	304	enlarge, or equip facilities, including roads and related
305	305	infrastructure, for projects to be financed through the issuance of
306	306	bonds in accordance with this subchapter and in accordance with a
307	307	systemwide revenue financing program adopted by the board for the
308	308	following institutions and facilities not to exceed the following
309	309	aggregate principal amounts for the projects specified as follows:
310	310	(1) the University of North Texas System, $40,000,000
311	311	for a College of Law;
312	312	(2) the University of North Texas, $63,000,000 for a
313	313	College of Visual Arts and Design building; and
314	314	(3) the University of North Texas Dallas Campus,
315	315	$18,500,000 for a second building.
316	316	(4) the University of North Texas Health Sciences
317	317	Center. $90,000,000 for a new Research Building
318	318	(b) The board may pledge irrevocably to the payment of bonds
319	319	authorized by this section all or any part of the revenue funds of
320	320	an institution, branch, or entity of the University of North Texas
321	321	System, including student tuition charges. The amount of a pledge
322	322	made under this subsection may not be reduced or abrogated while the
323	323	bonds for which the pledge is made, or bonds issued to refund those
324	324	bonds, are outstanding.
325	325	(c) If sufficient funds are not available to the board to
326	326	meet its obligations under this section, the board may transfer
327	327	funds among institutions, branches, and entities of the University
328	328	of North Texas System to ensure the most equitable and efficient
329	329	allocation of available resources for each institution, branch, or
330	330	entity to carry out its duties and purposes.
331	331	(d) Notwithstanding Subsection (a), the University of North
332	332	Texas System may not issue bonds under this section for facilities
333	333	at the University of North Texas Dallas Campus until the Texas
334	334	Higher Education Coordinating Board certifies that enrollment at
335	335	the University of North Texas Dallas Campus has reached an
336	336	enrollment equivalent of 1,500 full-time students for one semester.
337	337	If that enrollment is not reached by January 1, 2010, the system's
338	338	authority to issue bonds for the University of North Texas Dallas
339	339	Campus under this section expires on that date.
340	340	Sec. 55.1776. TEXAS WOMAN'S UNIVERSITY. (a) In addition to
341	341	the other authority granted by this subchapter, the board of
342	342	regents of Texas Woman's University may acquire, purchase,
343	343	construct, improve, renovate, enlarge, or equip facilities,
344	344	including roads and related infrastructure, for projects to be
345	345	financed through the issuance of bonds in accordance with this
346	346	subchapter and in accordance with a systemwide revenue financing
347	347	program adopted by the board for the following institutions and
348	348	facilities not to exceed the following aggregate principal amounts
349	349	for the projects specified as follows:
350	350	(1) $26,000,000 for a graduate research building;
351	351	(2) $17,500,000 for the renovation of the old main
352	352	building;
353	353	(3) $9,500,000 for a new academic support and
354	354	administrative support building; and
355	355	(4) $4,800,000 for infrastructure repair and upgrade.
356	356	(b) The board may pledge irrevocably to the payment of bonds
357	357	authorized by this section all or any part of the revenue funds of
358	358	Texas Woman's University, including student tuition charges. The
359	359	amount of a pledge made under this subsection may not be reduced or
360	360	abrogated while the bonds for which the pledge is made, or bonds
361	361	issued to refund those bonds, are outstanding.
362	362	Sec. 55.1777. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
363	363	BONDS. (a) In addition to the other authority granted by this
364	364	subchapter, the board of regents of Midwestern State University may
365	365	acquire, purchase, construct, improve, renovate, enlarge, or equip
366	366	facilities, including roads and related infrastructure, for
367	367	projects at Midwestern State University, to be financed through the
368	368	issuance of bonds in accordance with this subchapter not to exceed
369	369	the following aggregate principal amounts for the projects
370	370	specified as follows:
371	371	(1) $6,420,000 for Phase II of the renovation of the D.
372	372	L. Ligon Building; and
373	373	(2) $40,000,000 for the reconstruction of the Moffett
374	374	Library.
375	375	(b) The board may pledge irrevocably to the payment of bonds
376	376	authorized by this section all or any part of the revenue funds of
377	377	Midwestern State University, including student tuition charges.
378	378	The amount of a pledge made under this subsection may not be reduced
379	379	or abrogated while the bonds for which the pledge is made, or bonds
380	380	issued to refund those bonds, are outstanding.
381	381	Sec. 55.1778. STEPHEN F. AUSTIN STATE UNIVERSITY. (a) In
382	382	addition to the other authority granted by this subchapter, the
383	383	board of regents of Stephen F. Austin State University may acquire,
384	384	purchase, construct, improve, renovate, enlarge, or equip
385	385	facilities, including roads and related infrastructure, for a
386	386	molecular sciences building at Stephen F. Austin State University,
387	387	to be financed through the issuance of bonds in accordance with this
388	388	subchapter not to exceed the aggregate principal amount of
389	389	$46,000,000.
390	390	(b) The board may pledge irrevocably to the payment of bonds
391	391	authorized by this section all or any part of the revenue funds of
392	392	Stephen F. Austin State University, including student tuition
393	393	charges. The amount of a pledge made under this subsection may not
394	394	be reduced or abrogated while the bonds for which the pledge is
395	395	made, or bonds issued to refund those bonds, are outstanding.
396	396	Sec. 55.1779. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
397	397	BONDS. (a) In addition to the other authority granted by this
398	398	subchapter, the board of regents of the Texas Tech University
399	399	System may acquire, purchase, construct, improve, renovate,
400	400	enlarge, or equip facilities, including roads and related
401	401	infrastructure, for projects to be financed through the issuance of
402	402	bonds in accordance with this subchapter and in accordance with a
403	403	systemwide revenue financing program adopted by the board not to
404	404	exceed the following aggregate principal amounts for the projects
405	405	specified as follows:
406	406	(1) Texas Tech University Health Sciences Center:
407	407	(A) $72,000,000 for Lubbock
408	408	Education/Research/Technology and renovation;
409	409	(B) $58,500,000 for the EL Paso Medical Science
410	410	Building II;
411	411	(C) $27,000,000 for the El Paso Clinical Sciences
412	412	Building;
413	413	(D) $12,600,000 for the Permian Basin medical
414	414	education facility; and
415	415	(E) $14,850,000 for the Panhandle
416	416	clinical/hospital simulation center;
417	417	(2) Texas Tech University:
418	418	(A) $95,000,000 for the expansion and renovation
419	419	of the College of Engineering;
420	420	(B) $42,500,000 for a Plant and Soil Sciences
421	421	Building; and
422	422	(C) $45,000,000 for a performing arts center; and
423	423	(3) Angelo State University:
424	424	(A) $40,000,000 for the College of Nursing and
425	425	Allied Health;
426	426	(B) $35,000,000 for campus modernization and
427	427	expansion; and
428	428	(C) $42,325,000 for a Performing Arts Center.
429	429	(b) The board may pledge irrevocably to the payment of bonds
430	430	authorized by this section all or any part of the revenue funds of
431	431	an institution, branch, or entity of the Texas Tech University
432	432	System, including student tuition charges. The amount of a pledge
433	433	made under this subsection may not be reduced or abrogated while the
434	434	bonds for which the pledge is made, or bonds issued to refund those
435	435	bonds, are outstanding.
436	436	(c) If sufficient funds are not available to the board to
437	437	meet its obligations under this section, the board may transfer
438	438	funds among institutions, branches, and entities of the Texas Tech
439	439	University System to ensure the most equitable and efficient
440	440	allocation of available resources for each institution, branch, or
441	441	entity to carry out its duties and purposes.
442	442	Sec. 55.1780. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL BONDS.
443	443	(a) In addition to the other authority granted by this subchapter,
444	444	the board of regents of Texas Southern University may acquire,
445	445	purchase, construct, improve, renovate, enlarge, or equip
446	446	facilities, including roads and related infrastructure, for
447	447	projects at Texas Southern University, to be financed through the
448	448	issuance of bonds in accordance with this subchapter not to exceed
449	449	the following aggregate principal amounts for the projects
450	450	specified as follows:
451	451	(1) $46,000,000 for renovation of the Robert J. Terry
452	452	Library;
453	453	(2) $9,450,000 for a Spearman technology building;
454	454	(3) $4,500,000 for Multi-purpose Academic Center;
455	455	(4) $30,000,000 for deferred maintenance;
456	456	(5) $5,000,000 for asbestos abatement and removal;
457	457	(6) $10,000,000 for campus
458	458	infrastructure/beautification; and
459	459	(7) $4,000,000 for land acquisition/Multi-Purpose
460	460	Academic Center.
461	461	(b) The board may pledge irrevocably to the payment of bonds
462	462	authorized by this section all or any part of the revenue funds of
463	463	Texas Southern University, including student tuition charges. The
464	464	amount of a pledge made under this subsection may not be reduced or
465	465	abrogated while the bonds for which the pledge is made, or bonds
466	466	issued to refund those bonds, are outstanding.
467	467	Sec. 55.1781. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a) In
468	468	addition to the other authority granted by this subchapter, the
469	469	board of regents of the Texas State Technical College System may
470	470	acquire, purchase, construct, improve, renovate, enlarge, or equip
471	471	property, buildings, structures, facilities, roads, or related
472	472	infrastructure, for projects to be financed through the issuance of
473	473	bonds in accordance with this subchapter not to exceed the
474	474	following aggregate principal amounts for the projects specified as
475	475	follows:
476	476	(1) Texas State Technical College-Harlingen,
477	477	$8,000,000 to construct an academic building;
478	478	(2) Texas State Technical College-Brownwood,
479	479	$3,000,000 to renovate an academic building;
480	480	(3) Texas State Technical College-Marshall,
481	481	$2,500,000 for a diesel equipment technology building; and

483	483	(A) $10,000,000 for a learning services center;

485	485	(B) $5,000,000 for Phase II of the East
486	486	Williamson County Education Center.
487	487	(b) The board may pledge irrevocably to the payment of those
488	488	bonds all or any part of the revenue funds of an institution,
489	489	branch, or entity of the Texas State Technical College System,
490	490	including student tuition charges. The amount of a pledge made
491	491	under this subsection may not be reduced or abrogated while the
492	492	bonds for which the pledge is made, or bonds issued to refund those
493	493	bonds, are outstanding.
494	494	(c) If sufficient funds are not available to the board to
495	495	meet its obligations under this section, the board may transfer
496	496	funds among institutions, branches, and entities of the Texas State
497	497	Technical College System to ensure the most equitable and efficient
498	498	allocation of available resources for each institution, branch, or
499	499	entity to carry out its duties and purposes.
500	500	SECTION 2. Section 61.0572(e), Education Code, is amended
501	501	to read as follows:
502	502	(e) Approval of the board is not required to acquire real
503	503	property that is financed by bonds issued under Section 55.17(e)(3)
504	504	or (4), 55.1713-55.1718, 55.1721-55.1728, 55.1735(a)(1), 55.174,
505	505	55.1742, 55.1743, 55.1744, [or] 55.1751-55.17592, or
506	506	55.1771-55.1781, except that the board shall review all real
507	507	property to be financed by bonds issued under those sections to
508	508	determine whether the property meets the standards adopted by the
509	509	board for cost, efficiency, and space use. If the property does not
510	510	meet those standards, the board shall notify the governor, the
511	511	lieutenant governor, the speaker of the house of representatives,
512	512	and the Legislative Budget Board.
513	513	SECTION 3. Section 61.058(b), Education Code, is amended to
514	514	read as follows:
515	515	(b) This section does not apply to construction, repair, or
516	516	rehabilitation financed by bonds issued under Section 55.17(e)(3)
517	517	or (4), 55.1713-55.1718, 55.1721-55.1728, 55.174, 55.1742,
518	518	55.1743, 55.1744 [or] 55.1751-55.17.592 , or 55.1771-55.1781,
519	519	except that the board shall review all construction, repair, or
520	520	rehabilitation to be financed by bonds issued under those sections
521	521	to determine whether the construction, rehabilitation, or repair
522	522	meets the standards adopted by board rule for cost, efficiency, and
523	523	space use. If the construction, rehabilitation, or repair does not
524	524	meet those standards, the board shall notify the governor, the
525	525	lieutenant governor, the speaker of the house of representatives,
526	526	and the Legislative Budget Board.
527	527	SECTION 4. This Act does not affect any authority or
528	528	restriction regarding the activities that a public institution of
529	529	higher education may conduct in connection with a facility financed
530	530	by bonds authorized by this Act.
531	531	SECTION 5. This Act takes effect immediately if it receives
532	532	a vote of two-thirds of all the members elected to each house, as
533	533	provided by Section 39, Article III, Texas Constitution. If this
534	534	Act does not receive the vote necessary for immediate effect, this
535	535	Act takes effect on the 91st day after the last day of the
536	536	legislative session.
