66 AN ACT
77 relating to authorizing the Texas Board of Criminal Justice to sell
88 certain real property for municipal airport expansion.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 496.0021, Government Code, is amended by
1111 adding Subsections (c), (d), and (e) to read as follows:
1212 (c) The board shall authorize the sale of land directly to a
1313 municipality at fair market value without the requirement of a
1414 sealed bid sale if:
1515 (1) the municipality seeking to acquire the land
1616 notifies the department in writing of the municipality's desire to
1717 acquire the land for municipal airport expansion;
1818 (2) the land is located next to an active runway of a
1919 municipally owned airport;
2020 (3) the municipality is acquiring the land to expand
2121 municipal airport facilities; and
2222 (4) the department primarily uses the land for guard
2323 housing.
2424 (d) After receiving the notice required by Subsection (c),
2525 the board shall:
2626 (1) obtain an appraisal of the land to be sold to the
2727 municipality;
2828 (2) request that the municipality provide the board
2929 with an appraisal of the land to be sold;
3030 (3) determine whether a third appraisal by an
3131 appraiser mutually selected by the department and municipality is
3232 necessary to determine fair market value of the land to be sold; and
3333 (4) finalize the sale of the land to the municipality
3434 at fair market value within 18 months of receiving the written
3535 notice under Subsection (c).
3636 (e) In determining the fair market value of land to be sold
3737 under Subsection (c), the department shall consider the necessary
3838 remediation that must be completed before the land can be used for
3939 airport expansion. If a third appraisal is required under
4040 Subsection (d), the fair market value is considered to be the
4141 average of the three appraisals required under this section minus
4242 any remediation costs.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2009.
