55 relating to the penalties for theft of cattle, horses, exotic
66 livestock, exotic fowl, sheep, swine, or goats.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subsection (e), Section 31.03, Penal Code, is
99 amended to read as follows:
1010 (e) Except as provided by Subsection (f), an offense under
1111 this section is:
1212 (1) a Class C misdemeanor if the value of the property
1313 stolen is less than:
1414 (A) $50; or
1515 (B) $20 and the defendant obtained the property
1616 by issuing or passing a check or similar sight order in a manner
1717 described by Section 31.06;
1818 (2) a Class B misdemeanor if:
1919 (A) the value of the property stolen is:
2020 (i) $50 or more but less than $500; or
2121 (ii) $20 or more but less than $500 and the
2222 defendant obtained the property by issuing or passing a check or
2323 similar sight order in a manner described by Section 31.06; or
2424 (B) the value of the property stolen is less
2525 than:
2626 (i) $50 and the defendant has previously
2727 been convicted of any grade of theft; or
2828 (ii) $20, the defendant has previously been
2929 convicted of any grade of theft, and the defendant obtained the
3030 property by issuing or passing a check or similar sight order in a
3131 manner described by Section 31.06;
3232 (3) a Class A misdemeanor if the value of the property
3333 stolen is $500 or more but less than $1,500;
3434 (4) a state jail felony if:
3535 (A) the value of the property stolen is $1,500 or
3636 more but less than $20,000, or the property is less than 10 head of
3737 [cattle, horses, or exotic livestock or exotic fowl as defined by
3838 Section 142.001, Agriculture Code, or any part thereof under the
3939 value of $20,000, or less than 100 head of] sheep, swine, or goats
4040 or any part thereof under the value of $20,000;
4141 (B) regardless of value, the property is stolen
4242 from the person of another or from a human corpse or grave;
4343 (C) the property stolen is a firearm, as defined
4444 by Section 46.01;
4545 (D) the value of the property stolen is less than
4646 $1,500 and the defendant has been previously convicted two or more
4747 times of any grade of theft;
4848 (E) the property stolen is an official ballot or
4949 official carrier envelope for an election; or
5050 (F) the value of the property stolen is less than
5151 $20,000 and the property stolen is insulated or noninsulated wire
5252 or cable that consists of at least 50 percent:
5353 (i) aluminum;
5454 (ii) bronze; or
5555 (iii) copper;
5656 (5) a felony of the third degree if the value of the
5757 property stolen is $20,000 or more but less than $100,000, or the
5858 property is:
5959 (A) [10 or more head of] cattle, horses, or
6060 exotic livestock or exotic fowl as defined by Section 142.001,
6161 Agriculture Code, stolen during a single transaction and having an
6262 aggregate value of less than $100,000; or
6363 (B) 10 [100] or more head of sheep, swine, or
6464 goats stolen during a single transaction and having an aggregate
6565 value of less than $100,000;
6666 (6) a felony of the second degree if the value of the
6767 property stolen is $100,000 or more but less than $200,000; or
6868 (7) a felony of the first degree if the value of the
6969 property stolen is $200,000 or more.
7070 SECTION 2. The change in law made by this Act applies only
7171 to an offense committed on or after the effective date of this Act.
7272 An offense committed before the effective date of this Act is
7373 covered by the law in effect when the offense was committed, and the
7474 former law is continued in effect for that purpose. For purposes of
7575 this section, an offense was committed before the effective date of
7676 this Act if any element of the offense occurred before that date.
7777 SECTION 3. This Act takes effect September 1, 2009.
