9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 142.009(j), Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (j) Except as provided by Subsections (h) and (l), the | |
13 | 13 | department shall conduct an initial on-site survey not later than | |
14 | 14 | the first anniversary of the date the department issues an initial | |
15 | 15 | license [must be conducted within 18 months after a survey for an | |
16 | 16 | initial license]. After the initial survey [that time], the | |
17 | 17 | department shall conduct an on-site survey [must be conducted] at | |
18 | 18 | least every 36 months. | |
19 | 19 | SECTION 2. Section 142.009(j), Health and Safety Code, as | |
20 | 20 | amended by this Act, applies to an initial survey required to be | |
21 | 21 | conducted by the Department of Aging and Disability Services on or | |
22 | 22 | after the effective date of this Act. A survey required to be | |
23 | 23 | conducted before the effective date of this Act is governed by the | |
24 | 24 | law in effect at the time the survey is conducted, and the former | |
25 | 25 | law is continued in effect for that purpose. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
