99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 142.009(j), Health and Safety Code, is
1111 amended to read as follows:
1212 (j) Except as provided by Subsections (h) and (l), the
1313 department shall conduct an initial on-site survey not later than
1414 the first anniversary of the date the department issues an initial
1515 license [must be conducted within 18 months after a survey for an
1616 initial license]. After the initial survey [that time], the
1717 department shall conduct an on-site survey [must be conducted] at
1818 least every 36 months.
1919 SECTION 2. Section 142.009(j), Health and Safety Code, as
2020 amended by this Act, applies to an initial survey required to be
2121 conducted by the Department of Aging and Disability Services on or
2222 after the effective date of this Act. A survey required to be
2323 conducted before the effective date of this Act is governed by the
2424 law in effect at the time the survey is conducted, and the former
2525 law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2009.
