66 AN ACT
77 relating to the punishment prescribed for the offense of evading
88 arrest or detention.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 38.04, Penal Code, is
1111 amended to read as follows:
1212 (b) An offense under this section is a Class A [B]
1313 misdemeanor, except that the offense is:
1414 (1) a state jail felony if:
1515 (A) the actor has been previously convicted under
1616 this section; or
1717 (B) the actor uses a vehicle while the actor is in
1818 flight and the actor has not been previously convicted under this
1919 section;
2020 (2) a felony of the third degree if:
2121 (A) the actor uses a vehicle while the actor is in
2222 flight and the actor has been previously convicted under this
2323 section; or
2424 (B) another suffers serious bodily injury as a
2525 direct result of an attempt by the officer from whom the actor is
2626 fleeing to apprehend the actor while the actor is in flight; or
2727 (3) a felony of the second degree if another suffers
2828 death as a direct result of an attempt by the officer from whom the
2929 actor is fleeing to apprehend the actor while the actor is in
3030 flight.
3131 SECTION 2. The change in law made by this Act applies only
3232 to an offense committed on or after the effective date of this Act.
3333 An offense committed before the effective date of this Act is
3434 covered by the law in effect when the offense was committed, and the
3535 former law is continued in effect for that purpose. For purposes of
3636 this section, an offense was committed before the effective date of
3737 this Act if any element of the offense was committed before that
3838 date.
3939 SECTION 3. This Act takes effect September 1, 2009.

4141 Amend SB 1176 as follows:
4242 Strike all below the enacting clause and replace with the
4343 following:
4444 SECTION 1. This Act may be cited as the Amy Lynn Donovan
4545 Act.
4646 SECTION 2. Section 38.04(b), Penal Code, is amended to read
4747 as follows:
4848 (b) An offense under this section is a Class A [B]
4949 misdemeanor, except that the offense is:
5050 (1) a state jail felony if:
5151 (A) the actor has been previously convicted under
5252 this section; or
5353 (B) the actor uses a vehicle while the actor is in
5454 flight and the actor has not been previously convicted under this
5555 section;
5656 (2) a felony of the third degree if:
5757 (A) the actor uses a vehicle while the actor is in
5858 flight and the actor has been previously convicted under this
5959 section; or
6060 (B) another suffers serious bodily injury as a
6161 direct result of an attempt by the officer from whom the actor is
6262 fleeing to apprehend the actor while the actor is in flight; or
6363 (3) a felony of the second degree if another suffers
6464 death as a direct result of an attempt by the officer from whom the
6565 actor is fleeing to apprehend the actor while the actor is in
6666 flight.
6767 SECTION 3. The change in law made by this Act applies only
6868 to an offense committed on or after the effective date of this Act.
6969 An offense committed before the effective date of this Act is
7070 covered by the law in effect when the offense was committed, and the
7171 former law is continued in effect for that purpose. For purposes of
7272 this section, an offense was committed before the effective date of
7373 this Act if any element of the offense was committed before that
7474 date.
7575 SECTION 4. This Act takes effect September 1, 2009.
