66 AN ACT
77 relating to online and correspondence real estate and real estate
88 inspection courses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter G, Chapter 1101, Occupations Code, is
1111 amended by adding Section 1101.3051 to read as follows:
1212 Sec. 1101.3051. ONLINE AND CORRESPONDENCE COURSES. An
1313 accredited real estate or real estate inspection education program
1414 may offer a course required to obtain a license under this chapter
1515 or Chapter 1102 online or by correspondence if:
1616 (1) the program is a domestic entity, as defined by
1717 Section 1.002, Business Organizations Code;
1818 (2) the program's principal office is located in this
1919 state;
2020 (3) the course that is offered online or by
2121 correspondence is also offered with in-person instruction by the
2222 program at a physical location in this state;
2323 (4) the course:
2424 (A) has learning objectives for each area of
2525 instruction;
2626 (B) is measured in clock hours of instruction;
2727 (C) includes pre-assessments in each area of
2828 instruction to determine the student's level of competence before
2929 taking the course; and
3030 (D) includes post-assessments to determine the
3131 student's overall comprehension of the subject matter;
3232 (5) the program requires students who are completing a
3333 correspondence course to pass an examination administered by a
3434 proctor who meets requirements adopted by the commission by rule;
3535 (6) the program requires students who are completing
3636 an online course to pass an examination that includes a method to
3737 calculate the time for each question or time for each area of study;
3838 (7) the program provides for an instructor approved by
3939 the commission to be available by telephone or e-mail or online to
4040 answer students' questions; and
4141 (8) each of the program's instructors is approved by
4242 the commission.
4343 SECTION 2. This Act takes effect September 1, 2009.
