| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Subchapter G, Chapter 1101, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 1101.3051 to read as follows: |
|---|
| 12 | 12 | | Sec. 1101.3051. ONLINE AND CORRESPONDENCE COURSES. An |
|---|
| 13 | 13 | | accredited real estate or real estate inspection education program |
|---|
| 14 | 14 | | may offer a course required to obtain a license under this chapter |
|---|
| 15 | 15 | | or Chapter 1102 online or by correspondence if: |
|---|
| 16 | 16 | | (1) the program is a domestic entity, as defined by |
|---|
| 17 | 17 | | Section 1.002, Business Organizations Code; |
|---|
| 18 | 18 | | (2) the program's principal office is located in this |
|---|
| 19 | 19 | | state; |
|---|
| 20 | 20 | | (3) the course that is offered online or by |
|---|
| 21 | 21 | | correspondence is also offered with in-person instruction by the |
|---|
| 22 | 22 | | program at a physical location in this state; |
|---|
| 23 | 23 | | (4) the course: |
|---|
| 24 | 24 | | (A) has learning objectives for each area of |
|---|
| 25 | 25 | | instruction; |
|---|
| 26 | 26 | | (B) is measured in clock hours of instruction; |
|---|
| 27 | 27 | | (C) includes pre-assessments in each area of |
|---|
| 28 | 28 | | instruction to determine the student's level of competence before |
|---|
| 29 | 29 | | taking the course; and |
|---|
| 30 | 30 | | (D) includes post-assessments to determine the |
|---|
| 31 | 31 | | student's overall comprehension of the subject matter; |
|---|
| 32 | 32 | | (5) the program requires students who are completing a |
|---|
| 33 | 33 | | correspondence course to pass an examination administered by a |
|---|
| 34 | 34 | | proctor who meets requirements adopted by the commission by rule; |
|---|
| 35 | 35 | | (6) the program requires students who are completing |
|---|
| 36 | 36 | | an online course to pass an examination that includes a method to |
|---|
| 37 | 37 | | calculate the time for each question or time for each area of study; |
|---|
| 38 | 38 | | (7) the program provides for an instructor approved by |
|---|
| 39 | 39 | | the commission to be available by telephone or e-mail or online to |
|---|
| 40 | 40 | | answer students' questions; and |
|---|
| 41 | 41 | | (8) each of the program's instructors is approved by |
|---|
| 42 | 42 | | the commission. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2009. |
