55 relating to the liability of a volunteer audiologist, assistant in
66 audiology, speech-language pathologist, or assistant in
77 speech-language pathology.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subdivision (5), Section 84.003, Civil Practice
1010 and Remedies Code, is amended to read as follows:
1111 (5) "Volunteer health care provider" means an
1212 individual who voluntarily provides health care services without
1313 compensation or expectation of compensation and who is:
1414 (A) an individual who is licensed to practice
1515 medicine under Subtitle B, Title 3, Occupations Code;
1616 (B) a retired physician who is eligible to
1717 provide health care services, including a retired physician who is
1818 licensed but exempt from paying the required annual registration
1919 fee under Section 156.002, Occupations Code;
2020 (C) a physician assistant licensed under Chapter
2121 204, Occupations Code, or a retired physician assistant who is
2222 eligible to provide health care services under the law of this
2323 state;
2424 (D) a registered nurse, including an advanced
2525 nurse practitioner, or vocational nurse, licensed under Chapter
2626 301, Occupations Code, or a retired vocational nurse or registered
2727 nurse, including a retired advanced nurse practitioner, who is
2828 eligible to provide health care services under the law of this
2929 state;
3030 (E) a pharmacist licensed under Subtitle J, Title
3131 3, Occupations Code, or a retired pharmacist who is eligible to
3232 provide health care services under the law of this state;
3333 (F) a podiatrist licensed under Chapter 202,
3434 Occupations Code, or a retired podiatrist who is eligible to
3535 provide health care services under the law of this state;
3636 (G) a dentist licensed under Subtitle D, Title 3,
3737 Occupations Code, or a retired dentist who is eligible to provide
3838 health care services under the law of this state;
3939 (H) a dental hygienist licensed under Subtitle D,
4040 Title 3, Occupations Code, or a retired dental hygienist who is
4141 eligible to provide health care services under the law of this
4242 state;
4343 (I) an optometrist or therapeutic optometrist
4444 licensed under Chapter 351, Occupations Code, or a retired
4545 optometrist or therapeutic optometrist who is eligible to provide
4646 health care services under the law of this state;
4747 (J) a physical therapist or physical therapist
4848 assistant licensed under Chapter 453, Occupations Code, or a
4949 retired physical therapist or physical therapist assistant who is
5050 eligible to provide health care services under the law of this
5151 state; [or]
5252 (K) an occupational therapist or occupational
5353 therapy assistant licensed under Chapter 454, Occupations Code, or
5454 a retired occupational therapist or occupational therapy assistant
5555 who is eligible to provide health care services under the law of
5656 this state; or
5757 (L) an audiologist, assistant in audiology,
5858 speech-language pathologist, or assistant in speech-language
5959 pathology licensed under Chapter 401, Occupations Code, or a
6060 retired audiologist, assistant in audiology, speech-language
6161 pathologist, or assistant in speech-language pathology who is
6262 eligible to provide health care services under the laws of this
6363 state.
6464 SECTION 2. The changes in law made by this Act apply only to
6565 a cause of action that accrues on or after the effective date of
6666 this Act. An action that accrues before the effective date of this
6767 Act is governed by the law applicable to the action immediately
6868 before the effective date of this Act, and that law is continued in
6969 effect for that purpose.
7070 SECTION 3. This Act takes effect September 1, 2009.
