8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subdivision (5), Section 84.003, Civil Practice |
---|
10 | 10 | | and Remedies Code, is amended to read as follows: |
---|
11 | 11 | | (5) "Volunteer health care provider" means an |
---|
12 | 12 | | individual who voluntarily provides health care services without |
---|
13 | 13 | | compensation or expectation of compensation and who is: |
---|
14 | 14 | | (A) an individual who is licensed to practice |
---|
15 | 15 | | medicine under Subtitle B, Title 3, Occupations Code; |
---|
16 | 16 | | (B) a retired physician who is eligible to |
---|
17 | 17 | | provide health care services, including a retired physician who is |
---|
18 | 18 | | licensed but exempt from paying the required annual registration |
---|
19 | 19 | | fee under Section 156.002, Occupations Code; |
---|
20 | 20 | | (C) a physician assistant licensed under Chapter |
---|
21 | 21 | | 204, Occupations Code, or a retired physician assistant who is |
---|
22 | 22 | | eligible to provide health care services under the law of this |
---|
23 | 23 | | state; |
---|
24 | 24 | | (D) a registered nurse, including an advanced |
---|
25 | 25 | | nurse practitioner, or vocational nurse, licensed under Chapter |
---|
26 | 26 | | 301, Occupations Code, or a retired vocational nurse or registered |
---|
27 | 27 | | nurse, including a retired advanced nurse practitioner, who is |
---|
28 | 28 | | eligible to provide health care services under the law of this |
---|
29 | 29 | | state; |
---|
30 | 30 | | (E) a pharmacist licensed under Subtitle J, Title |
---|
31 | 31 | | 3, Occupations Code, or a retired pharmacist who is eligible to |
---|
32 | 32 | | provide health care services under the law of this state; |
---|
33 | 33 | | (F) a podiatrist licensed under Chapter 202, |
---|
34 | 34 | | Occupations Code, or a retired podiatrist who is eligible to |
---|
35 | 35 | | provide health care services under the law of this state; |
---|
36 | 36 | | (G) a dentist licensed under Subtitle D, Title 3, |
---|
37 | 37 | | Occupations Code, or a retired dentist who is eligible to provide |
---|
38 | 38 | | health care services under the law of this state; |
---|
39 | 39 | | (H) a dental hygienist licensed under Subtitle D, |
---|
40 | 40 | | Title 3, Occupations Code, or a retired dental hygienist who is |
---|
41 | 41 | | eligible to provide health care services under the law of this |
---|
42 | 42 | | state; |
---|
43 | 43 | | (I) an optometrist or therapeutic optometrist |
---|
44 | 44 | | licensed under Chapter 351, Occupations Code, or a retired |
---|
45 | 45 | | optometrist or therapeutic optometrist who is eligible to provide |
---|
46 | 46 | | health care services under the law of this state; |
---|
47 | 47 | | (J) a physical therapist or physical therapist |
---|
48 | 48 | | assistant licensed under Chapter 453, Occupations Code, or a |
---|
49 | 49 | | retired physical therapist or physical therapist assistant who is |
---|
50 | 50 | | eligible to provide health care services under the law of this |
---|
51 | 51 | | state; [or] |
---|
52 | 52 | | (K) an occupational therapist or occupational |
---|
53 | 53 | | therapy assistant licensed under Chapter 454, Occupations Code, or |
---|
54 | 54 | | a retired occupational therapist or occupational therapy assistant |
---|
55 | 55 | | who is eligible to provide health care services under the law of |
---|
56 | 56 | | this state; or |
---|
57 | 57 | | (L) an audiologist, assistant in audiology, |
---|
58 | 58 | | speech-language pathologist, or assistant in speech-language |
---|
59 | 59 | | pathology licensed under Chapter 401, Occupations Code, or a |
---|
60 | 60 | | retired audiologist, assistant in audiology, speech-language |
---|
61 | 61 | | pathologist, or assistant in speech-language pathology who is |
---|
62 | 62 | | eligible to provide health care services under the laws of this |
---|
63 | 63 | | state. |
---|
64 | 64 | | SECTION 2. The changes in law made by this Act apply only to |
---|
65 | 65 | | a cause of action that accrues on or after the effective date of |
---|
66 | 66 | | this Act. An action that accrues before the effective date of this |
---|
67 | 67 | | Act is governed by the law applicable to the action immediately |
---|
68 | 68 | | before the effective date of this Act, and that law is continued in |
---|
69 | 69 | | effect for that purpose. |
---|
70 | 70 | | SECTION 3. This Act takes effect September 1, 2009. |
---|
