55 AN ACT
66 relating to granting limited state law enforcement authority to
77 special agents of the Office of Inspector General of the United
88 States Department of Veterans Affairs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Article 2.122, Code of Criminal
1111 Procedure, is amended to read as follows:
1212 (a) The following named criminal investigators of the
1313 United States shall not be deemed peace officers, but shall have the
1414 powers of arrest, search and seizure as to felony offenses only
1515 under the laws of the State of Texas:
1616 (1) Special Agents of the Federal Bureau of
1717 Investigation;
1818 (2) Special Agents of the United States Secret
1919 Service;
2020 (3) Special Agents of the United States Immigration
2121 and Customs Enforcement agency [Customs Service];
2222 (4) Special Agents of the Bureau of Alcohol, Tobacco,
2323 [and] Firearms and Explosives;
2424 (5) Special Agents of the United States [Federal] Drug
2525 Enforcement Administration [Agency];
2626 (6) Inspectors of the United States Postal Inspection
2727 Service;
2828 (7) Special Agents of the Criminal Investigation
2929 Division and Inspectors of the Internal Security Division of the
3030 Internal Revenue Service;
3131 (8) Civilian Special Agents of the United States Naval
3232 Criminal Investigative Service;
3333 (9) Marshals and Deputy Marshals of the United States
3434 Marshals Service;
3535 (10) [Special Agents of the United States Immigration
3636 and Naturalization Service; and
3737 [(11)] Special Agents of the United States Department
3838 of State, Bureau of Diplomatic Security; and
3939 (11) Special Agents of the Office of Inspector General
4040 of the United States Department of Veterans Affairs.
4141 SECTION 2. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
