55 relating to faculty temporary licenses to practice medicine.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Subsections (b), (e), (g), and (h), Section
88 155.104, Occupations Code, are amended to read as follows:
99 (b) The board may issue a faculty temporary license to
1010 practice medicine to a physician [appointed by a medical school in
1111 this state] as provided by this section. The physician:
1212 (1) must hold a current medical license that is
1313 unrestricted and not subject to a disciplinary order or probation
1414 in another state or a Canadian province or have completed at least
1515 three years of postgraduate residency;
1616 (2) may not hold a medical license in another state or
1717 a Canadian province that has any restrictions, disciplinary orders,
1818 or probation;
1919 (3) must pass the Texas medical jurisprudence
2020 examination; and
2121 (4) must hold a salaried faculty position equivalent
2222 to [of] at least the level of assistant professor and be working
2323 full-time at one of the following institutions:
2424 (A) The University of Texas Medical Branch at
2525 Galveston;
2626 (B) The University of Texas Southwestern Medical
2727 Center at Dallas;
2828 (C) The University of Texas Health Science Center
2929 at Houston;
3030 (D) The University of Texas Health Science Center
3131 at San Antonio;
3232 (E) The University of Texas Health Center at
3333 Tyler;
3434 (F) The University of Texas M. D. Anderson Cancer
3535 Center;
3636 (G) Texas A&M University College of Medicine;
3737 (H) the Schools of Medicine at Texas Tech
3838 University Health Sciences Center [School of Medicine];
3939 (I) Baylor College of Medicine; [or]
4040 (J) the University of North Texas Health Science
4141 Center at Fort Worth;
4242 (K) an institutional sponsor of a graduate
4343 medical education program accredited by the Accreditation Council
4444 for Graduate Medical Education; or
4545 (L) a nonprofit health corporation certified
4646 under Section 162.001 and affiliated with a program described by
4747 Paragraph (K).
4848 (e) A physician holding a temporary license under
4949 Subsection (b) and the physician's institution [medical school]
5050 must file affidavits with the board affirming acceptance of the
5151 terms and limits imposed by the board on the medical activities of
5252 the physician.
5353 (g) The holder of a temporary license issued under
5454 Subsection (b) is limited to the teaching confines of the applying
5555 institution [medical school] as a part of the physician's duties
5656 and responsibilities assigned by the institution [school] and may
5757 not practice medicine outside of the setting of the institution
5858 [medical school] or an affiliate of the institution [medical
5959 school]. The physician may participate in the full activities of
6060 the department of any hospital for which the physician's
6161 institution [medical school] has full responsibility for clinical,
6262 patient care, and teaching activities.
6363 (h) The application for a temporary license under
6464 Subsection (b) must be made by the chairman of the department of the
6565 institution [medical school] in which the physician teaches, or the
6666 person holding the equivalent position at the institution where the
6767 physician teaches, and must contain the information and
6868 documentation requested by the department. The application must be
6969 endorsed by the dean of the medical school or the president of the
7070 institution.
7171 SECTION 2. This Act takes effect immediately if it receives
7272 a vote of two-thirds of all the members elected to each house, as
7373 provided by Section 39, Article III, Texas Constitution. If this
7474 Act does not receive the vote necessary for immediate effect, this
7575 Act takes effect September 1, 2009.
