| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle C, Title 5, Business & Commerce Code, as |

| 11 | 11 | | effective April 1, 2009, is amended by adding Chapter 106 to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | CHAPTER 106. INCREASING AWARENESS OF NATIVE PLANT SPECIES |
|---|
| 14 | 14 | | Sec. 106.101. DEFINITION. In this chapter, "plant nursery" |
|---|
| 15 | 15 | | means a business that sells plants to the public. The term includes |
|---|
| 16 | 16 | | a landscaping service. |
|---|
| 17 | 17 | | Sec. 106.102. REQUIREMENT. A plant nursery shall make |
|---|
| 18 | 18 | | available to its customers a printed copy of the brochure developed |
|---|
| 19 | 19 | | by the Texas Parks and Wildlife Department under Section 12.0105, |
|---|
| 20 | 20 | | Parks and Wildlife Code, that describes the benefits of native |
|---|
| 21 | 21 | | plant species and the problems associated with invasive plant |
|---|
| 22 | 22 | | species. The plant nursery may satisfy the requirement of this |
|---|
| 23 | 23 | | section by posting in a conspicuous location accessible to the |
|---|
| 24 | 24 | | nursery's customers a sign that contains the department's Internet |
|---|
| 25 | 25 | | website address for the brochure. |

| 26 | 26 | | SECTION 2. Subchapter A, Chapter 12, Parks and Wildlife |
|---|
| 27 | 27 | | Code, is amended by adding Section 12.0105 to read as follows: |
|---|
| 28 | 28 | | Sec. 12.0105. The department may develop and maintain on |
|---|
| 29 | 29 | | the department's Internet website a brochure describing the |
|---|
| 30 | 30 | | benefits of native plant species and the problems associated with |
|---|
| 31 | 31 | | invasive plant species. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2009. |
