77 relating to increasing public awareness of the benefits of native

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 5, Business & Commerce Code, as
1111 effective April 1, 2009, is amended by adding Chapter 106 to read as
1212 follows:
1313 CHAPTER 106. INCREASING AWARENESS OF NATIVE PLANT SPECIES
1414 Sec. 106.101. DEFINITION. In this chapter, "plant nursery"
1515 means a business that sells plants to the public. The term includes
1616 a landscaping service.
1717 Sec. 106.102. REQUIREMENT. A plant nursery shall make
1818 available to its customers a printed copy of the brochure developed
1919 by the Texas Parks and Wildlife Department under Section 12.0105,
2020 Parks and Wildlife Code, that describes the benefits of native
2121 plant species and the problems associated with invasive plant
2222 species. The plant nursery may satisfy the requirement of this
2323 section by posting in a conspicuous location accessible to the
2424 nursery's customers a sign that contains the department's Internet
2525 website address for the brochure.
2626 SECTION 2. Subchapter A, Chapter 12, Parks and Wildlife
2727 Code, is amended by adding Section 12.0105 to read as follows:
2828 Sec. 12.0105. The department may develop and maintain on
2929 the department's Internet website a brochure describing the
3030 benefits of native plant species and the problems associated with
3131 invasive plant species.
3232 SECTION 3. This Act takes effect September 1, 2009.
