9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 228.006, Transportation Code, is amended | |
11 | 11 | by amending Subsection (a) and adding Subsection (a-1) to read as | |
12 | 12 | follows: | |
13 | 13 | (a) The commission shall authorize the use of surplus | |
14 | 14 | revenue of a toll project or system to pay the costs of a | |
15 | 15 | transportation project, highway project, or air quality project in | |
16 | 16 | the region [within a department district] in which [any part of] the | |
17 | 17 | toll project or system is located. | |
18 | 18 | (a-1) The department shall allocate the distribution of the | |
19 | 19 | surplus toll revenue to department districts in the region that are | |
20 | 20 | located in the boundaries of the metropolitan planning organization | |
21 | 21 | in which the toll project or system is located based on the | |
22 | 22 | percentage of toll revenue from users in each department district | |
23 | 23 | of the project or system. To assist the department in determining | |
24 | 24 | the allocation, each entity responsible for collecting tolls for a | |
25 | 25 | project or system shall calculate on an annual basis the percentage | |
26 | 26 | of toll revenue from users of the project or system in each | |
27 | 27 | department district based on the number of recorded electronic toll | |
28 | 28 | collections. | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2009. |
