77 relating to discount programs for certain veterans provided by toll
88 project entities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 371, Transportation Code, as added by
1111 Chapters 103 (H.B. 570) and 258 (S.B. 11), Acts of the 80th
1212 Legislature, Regular Session, 2007, is reenacted, redesignated as
1313 Chapter 372, Transportation Code, and amended to read as follows:
1414 CHAPTER 372 [371]. PROVISIONS APPLICABLE TO MORE THAN ONE TYPE OF
1515 TOLL PROJECT
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 372.001 [371.001]. DEFINITIONS. In this chapter:
1818 (1) "Toll project" means a toll project described by
1919 Section 201.001(b), regardless of whether the toll project:
2020 (A) is a part of the state highway system; or
2121 (B) is subject to the jurisdiction of the
2222 department.
2323 (2) "Toll project entity" means an entity authorized
2424 by law to acquire, design, construct, finance, operate, and
2525 maintain a toll project, including:
2626 (A) the department under Chapter 227 or 228;
2727 (B) a regional tollway authority under Chapter
2828 366;
2929 (C) a regional mobility authority under Chapter
3030 370; or
3131 (D) a county under Chapter 284.
3232 SUBCHAPTER B. TOLL PROJECT OPERATION
3333 Sec. 372.051 [371.051]. USE OF MOTOR VEHICLE REGISTRATION
3434 OR LICENSE PLATE INFORMATION. (a) A toll project entity may not
3535 use motor vehicle registration or other information derived from a
3636 license plate on a vehicle using a toll project, including
3737 information obtained by the use of automated enforcement technology
3838 described by Section 228.058, for purposes other than those related
3939 to:
4040 (1) toll collection and toll collection enforcement;
4141 and
4242 (2) law enforcement purposes on request by a law
4343 enforcement agency[, subject to Section 228.058(d)].
4444 (b) If a toll project entity enters into an agreement with
4545 an entity in another state that involves the exchange of motor
4646 vehicle registration or license plate information for toll
4747 collection or toll collection enforcement purposes, the agreement
4848 must provide that the information may not be used for purposes other
4949 than those described in Subsection (a).
5050 Sec. 372.052 [371.001]. VEHICLES USED BY NONPROFIT
5151 DISASTER RELIEF ORGANIZATIONS. [(a) In this section:
5252 [(1) "Toll project" means a toll project described by
5353 Section 201.001(b), regardless of whether the toll project is:
5454 [(A) a part of the state highway system; or
5555 [(B) subject to the jurisdiction of the
5656 department.
5757 [(2) "Toll project entity" means an entity authorized
5858 by law to acquire, design, construct, finance, operate, and
5959 maintain a toll project, including:
6060 [(A) the department under Chapter 227 or 228;
6161 [(B) a regional tollway authority under Chapter
6262 366;
6363 [(C) a regional mobility authority under Chapter
6464 370; or
6565 [(D) a county under Chapter 284.
6666 [(b)] A toll project entity may not require a vehicle
6767 registered under Section 502.203 to pay a toll for the use of a toll
6868 project.
6969 Sec. 372.053. VETERAN DISCOUNT PROGRAM. (a) A toll project
7070 entity may establish a discount program for electronic toll
7171 collection customers. The program must include free or discounted
7272 use of the entity's toll project by an electronic toll collection
7373 customer whose account relates to a vehicle registered:
7474 (1) under Section 504.202;
7575 (2) under Section 504.315(g); or
7676 (3) by a person who has received the Medal of Honor.
7777 (b) The legislature may appropriate funds from the general
7878 revenue fund to a toll project entity to defray the cost of
7979 providing free or discounted use of the entity's toll project under
8080 this section.
8181 SECTION 2. This Act takes effect September 1, 2009.
